For a year now, I have been dealing with LVNV. I have sent DV letter after dv letter, no response, just pass it on to one of their many other collectors. Today I get another one from as "attorney" collecting for them, with the mini-miranda. Guess I'll DV them too! For a year I have explained this account was opened in 1982, haven't charged on it for 13+ years, but were stupid and have been making mostly min. payments since then-2o something years!! They have added over 100 dollars a month at least, so balance is climbing! I think I'll send this dv letter along with everyone I have sent in the past year to them!!..KAren

Karen, do you remember when the last payment was done? Also, is this account still reported in your credit copy?

Howard, the last payment made to Sears was 12-05, LVNV bought it 1-06. We were really stupid to pay Sears all those years, fees, interest and min. payments!!I cringe when I think about how much we actually have paid all these years!..Karen Haven't checked cr lately, last time was reported,charged off, LVNv bought it, or something to that effect..

Surely, you'll have to get the debt validated from this attorney before making further payments. What I think is you must calculate the total payments done all these years. That way, you will be able to propose a settlement on the outstanding balance.

Karen, I agree with Howard. You should be able to get some sort of settlement with them and finally get them off your back. The best of luck to you.

Bossy, I'm right with you on the Sears thing.I used to post here under guest from time to time ( not the bad talking guests )You might remember me posting about my dealing with LVNV,and how they took me to court.
Well I DVd the attourney about 4 months ago also and still nothing.Only 3 court hearings later and just the big run around.Even after it was dismissed they still call daily.Iguess they figure since it was dismissed without prejudice they can still hold that over my head.

Actually, I probably only charged maybe 2-3 thousand on it starting in 1982, made payments all these years, haven't charged in 13= years, so, don't have any idea, except, I have probably overpaid for these things at least twice over. Tried to work payment or settlement, they wanted 3 thousand, over double what my balance was with Sears..Karen

Hi Karen,
Okay, go ahead and send the dv letter to the attorney's office. Don't let that get you frustrated or scared because it is an attorney's office. They have to follow the fdcpa rules just like everyone else. I would also dispute the amount, well you know that drill. Also, what are the collection laws in your state? This might be beneficial to find out if they can actually charge all this additional interest.

Thanks guys! You would think after a year, they would give up, especially when they know I'll just send another DV letter!! They are now calling about 8 times a day, I just don't answer and delete them! I've tried talking to several before, and all they do is scream and tell me how I'm not responsible, and what would my husband think if he knew I was doing this I had a good laugh on that one, told them they didn't even want to know what my husband said about them!!..Karen

I have the same thing going on with Weltman, Weinberg and Reese. I had a Sears account ages ago. Everytime I send a DV letter, I never hear from the collection agency and it shows up at another agency a few months later, with more fees added on! Now I'm to the point that there is no way I am going to pay that amount. Even if the debt is a valid one. I wold like to pay this old debt, but now I'm to the point where I don't feel I should. I've paid so much on it in the past.
