If the debt is more then 5 years old it proabaly no good anymore check your state laws. Also if they call your relatives more than once they can sue them for $1000 under FDCPA and any state laws where you live. Also can be sued under the telephone consumer protection act if you have no prior business with them and are on the do not call list, $500 per call, or they are calling your cell phone and you did not give them permission to call your cell phone.

I forgot also under the the consumer protection act they have to start with a live person on the phone not a prerecorded message. If you can keep any message left it is also $500.00 per call you can sue them for.

Debt collectors don't have to abide by the do not call list..that list is for telemarketers. It is true that they can only call others one time in a effort to find the person, though they may not disclose anything about the debt, or that there even IS a debt.

Where did you get the $500 if they call with a prerecorded message? I would like to look over that statute.

yes they are a collection agency for bank of america. it the numbers are real and so are they yes you can be taken to court are make a deal with them dont think they are not . they are serious and i would get a hold of them are your bill keeps going higher

I was recently contacted by Greystone Alliance Collection Agency. They said they were handling my Wells Fargo loan which was terribly delinquent (which it is). First, I checked the BBB website. They are not accredited. So I went to the source: I called Wells Fargo and told them I was contacted by a collection agency, and asked them the name of the company THEY HAD TURNED MY ACCOUNT OVER TO. I was given the name and the phone number. It was NOT Greystone, but upon calling them, they CONFIRMED that they had "sold" or "passed along" (not sure of the correct term) the account to Greystone. Through this process, I was able to verify that I was giving my money to the people who were responsible for my account. I am making monthly payments now and working towards settling this debt. This would be my advice for anyone unsure of the company who has contacted them.

i dob't condone your course at all.it is up to whoever is attempting to collect.so you suggest jumping through a bunch of hoops and just because a place owns the debt doesn't mean they are entitled to collect on it.plus you never gave details on how you were contacted.if it was by letter the proper thing was to send them a DV(debt validation)letter certified mail return receipt.if it was by phone you demand something in writing first.bottomline you are paying a bottomfeeder and chances are good another such place will be calling on this again.so to close i wouldn't do so much as it is up to the bottomfeeder to the work to prove the debt not yours.

I don't owe anybody anything. I am debt free. However, Greystone still calls me, as do some others. Even when I tell them I do not know the person they are calling for and to stop calling me. They just continue to call back, and get ruder and more threatening. So what is you're whole point to your post? You must be one of the rude, obnoxious and threatening people who make these calls.

The DNCR, is for both Telemarketers and debt collectors. Although a lot of the FDCPA also covers the same things the DNCR does. Another note, it is illegal for a telemarketer and a debt collector to call you on a cell phone, even if the cell phone is not on the DNCR, it is still illegal for them to call you on a cell phone......

well you are wrong in every way.for one i have nothing but contempt for greystone and other piece of compost JDB.it's just to beat them back you need to know the FDCPA,your state law in regards to recording calls,and most important is this.once a debt is sold you deal with the bottomfeeder that has it,not the OC.the post was stupid and bsaically suggested jumping throught alot of hoops to confirm that indeed greystone owns the debt.BFD!there are alot of factors at work such as.

1)is the debt within SOL(statute of limitations)this is important as JDB'S buy debt that is past SOL,and violate the FDCPA to try and get money out of someone.
2)in some states an entity must be licensed to collect in that state.my state IL is one of those.meaning to contact me about the debt and attempt to collect they must have a license in IL.
3)per the FDCPA anybody attempting collections must send a letter 5 days after initial contact.in fact you should demand that before going forward.meaning do not talk to them at all until you receive that letter.

there you go,and btw the DNCR does not apply to collectors however spoofing caller id is a violation no matter who you are.so just know before you go off on me and post bad info know i will respond.
