They apparently bought an old Payday loan from another CA that my attorney was dealing with. I called to refer them to my attorney. I was told that I had raised to the next level. Ooooooh! I tried to tell Omar thatI did not owe this and proceeded to give him my attorneys name and told him he will have to validate the debt to my attorney. He went off on me like a crazy person. Said he does not have to contact my attorney or validate anything. Thats my job. Said he would see me in court. I told him that he was in violation of the fdcpa for continuing to talk after he was informed I was represented but he just kept ranting about my credit or something. I finally had to hang up on him. I won't see him in court but I will bet I will settle out of court with them in my favor.
The best was he told me the call was being recorded for quality purposes!

my personal opinion,they are the same idiots who you are persuing.they just changed names.wouldn't put it past the foreign moron squad.

They made it to Bud's site. I read about them several months ago and thought that their name could be a violation of the fdcpa

They may have been recording but where you? Very rarely do agencies record or even bother to keep the tapes.

Contrary to what people on the forum often say, you do not need to record a collection agency to win a case against them. I know I have done it. They will settle many time because it is cheaper than fighting a case they would probably lose. They consider it the cost of doing business. They know only one in ine thousand will actually follow through with a suit. I happened to be that one! Besides that this state does not allow recording without consent.

I don't believe any states allow tape recorded conversations unless you let the person your recording know you are. Some states payday loans are actually illegal. No kidding. So you should check your state and see. Most collectors really do not want to take something to court anyway just as Frog said. What they will do is harass you for a lifetime though.

Actually the majority of states are 1 party states.
