Collection Agency or Original Creditor

I called my original creditor which is a hsbc account today and they said my account has been turned over to collections which is corporate receivables. long story short, I had been sending letters to my hsbc account regarding why my first payment was late and wanted to change my due date since my checking account was closed. Well they never responded and just kept on tacking on late charges. This agency says I have not made a payment since november to my hsbc account and that is a false statement. What do I do. Should I work with the original creditor or the collection agency?

Also another question. I have this creditors exchange that called me yesterday at my job and then I told them not to call me at my place of work. Well he called again this morning. What do I do in this case. I am starting out the new year and trying to get all my ducks in a row and want to do things right... Thanks for all of your help.

louise..how much do you owe to HSBC??..why was your checking account closed? ..and is the creditors exchange calling for other companies as well? Or do you think the creditors exchange is only calling for HSBC? I myself would try to deal with original creditor but it depends on how old it is! good luck!

When dealing with a CA, a DV letter is usually not a bad idea.

called me on my job again and I have let them know twice not to call on my job. I am going to get this cease and desist letter out to them.

HSBC doesn't mess around. If you have proof that you made payments after the month of November I suggest you get copies and mail it to them. I would even suggest that you fax it to them and call the next day.

I am assuming that the card isn't charged off if this is the first CA to have it. So it's likely still interest bearing and could be being assesed late and over the limit fee's (if applicable). Cards generally charge off when they have gone 180-210 days without payment.

Paying your total past due balance should help stop the late fee's and over the limit fee's (if being charged those) but it won't do anything for the interest.

If the account is not charged off yet and still is interest bearing then you should continue to receive a monthly statement.

if the original creditor will not deal with you then the debt is dead... dont ever deal with a ca ... they have no legal or lawful standing///

P.S. regarding post that hsbc doesn't MESS AROUND.."who originally the freakin hekkity heck thought about messin around here?"no credit card companies mess around..ever.....is hsbc more powerful than other companies on debts out of sol? nope maybe company someone else might work for? very strange post about doesn't mess around!

This statement is oh so wrong! Legally the debt is not dead until the SOL runs out. The CA might not be able to get the $$ out of you but they can recommend that the account be sued on immediately. And depending on the type of debt, you could find yourself being sued for judgement lickity split!

With student loans, if you cease or tell the CA where to shove it, you'll end up finding wages garnished faster than you can blink.

right on target soaplady,just because a debt is with a ca doesn't mean it's not valid.there are alot of ca's that work within the fdcpa.correct me if i'm wrong,but the sol is longer for certain debts.

Okay I just called the original creditor and they told me that account has been turned over to collection agency. I told them I would rather work with them and let them know that I have sent them money, which they show. They said they just send a letter to the collection agency and let them know payment has been received. The original collection also advised that if I don't want them to call to send a cease and desist letter. I don't know which way to go. The ca is offering 10% off the debt, I just don't trust these collection agencies. Anyone have any suggestions. Thanks as always.

I have never been in this situation louise..but I hope some of the experts will be along to help you soon...
from what I have read on this sight..you should always try to deal with the original creditor when at all possible..but if they have received payment..and are telling you that you need to deal with collection agency..can't they call and put a stop to this if they are going to work with you?..if the Ca doesn't collect..they don't get their commission..but if original creditor turned it over to them they are not going to receive full amount you owe anyways..I just don't want to see you paying one and still owing the other..and I hope someone comes along soon with expert advice!
