How To Sue A Debt Collector? Where do I start?

Hello All,

I wish to sue a credit collector. Midland Credit Management. I have sent two requests to the FTC today to seek help with Midlands FDCA and FDCPA violations which I have the documentation to back up. Do I find a lawyer? Where would I find a lawyer who deals with consumer law issues? Are these suits ever successful? Any ideas of what to brace for from any debt collector being sued and their reactions?

I think that some people have been successful because most of the time these creditor's don't think that people are serious about going after them for all of their violations. Keep us posted, there are alot of members on this board that will give you guidance.

You can also take it to small claims court if you can't find a lawyer. You could even file it yourself in a higher court, but there are many, many more rules you would have to know to do it correctly, but it can be done.

Study up on the Fdcpa, federal rules of civil procedure,and your state's rules of civil procedure. Best thing to do is files small claims and if they remove to federal they get to pay the removal cost. Laughing

You can immediately sue these scumbag collectors for every low-life, illegal thing they do. The day of the collector has come to an end. People are becoming wise to these scams and illegal tactics these bottom feeders use.

They will pay.

I am happy to brighten your day. I'm sorry my brother hassles all you fine people here, but he is...a little slow, you know how that is. Everyone has at least one in their family.

Just know that I am here to fight the good fight and let all people know about these horribly illegal tactics collectors like my brother NNC use.

We may have to put up with them, but we don't have to put up with their illegal tactics any longer!

Has your family thought of maybe disowning the little creep? I would give it serious consideration, because he's bringing shame to the noble family name of "No Nonsense!"

I did not owe the debt to begin with and for some reason the debt collector can't seem to validate its mine. Want me to pay someone else's debt? Seems the 3 major credit reporting agencies have found out the debt is not mine as well...hmmm wonder why they wiped the "alleged" debt off? Maybe because it's not MINE you idiot! No Non Sense I am scared for your children.

As for everyone else I will read up on the law. I will let you know step by step what happens. Right now I am waiting to hear from FTC in hopes they will take it on, and also seeking legal aid in help with filing this. "Alleged" debt was in Pa. 9 yrs ago, I live in Fl, and Midland operates out of San Diego. Wondering who's jurisdiction this involves. Also, filed complaints with all Attorney general's offices within the 3 above states. Just covering my bases. Now comes the studying. Never thought people could treat others this way. I have paid down all my debt besides 1000 worth in the last year, so i am not the kind of person to skip out but this company doesn't care whose debt it is....they have picked me to pay it... Much thanks to ya all!
