GE Moneybank or Encore

Does anyone have any tips on settling a debt with GeMoneyBank or Encore (their CA). They have sent me bills for two accounts generated by a deceased girlfriend. She apparently put my name on them. GEMB does not respond to my letters. I have been holding my income tax money to settle, but the accounts just get bigger and bigger. Can anyone help me?

Were the debts, Encore (CA) is talking about, joint? If not, then I don't think that any collection agency can try to collect it from you. But I am not sure on this. Others may help you more.

In what way did she put you on the account? Did she merely put you on her card as an authorized user; or did she fraudulently open the card in your name?

I'm just trying to see to what degree you are actually responsible for the debt?

I think I may have co-signed on one but the other one I think she must have signed my name because I sure don't remember doing it. I vaguely remember signing on something (STUPID) but then never saw any bills or anything until they started calling me. I'm just not sure what I should do...

If you have co-signed, then I think you are responsible for paying-off the debt. I am not fully sure on it. Other members could shed some light on it.

If you are joint on account,you are liable for account.If someone else signed your name without your knowledge,the account is fraudulent.The method of disputing a fraudulent account opens legal issues to your girlfriend's estate.

If she opened an account w/o your knowledge or consent then it is a case of ID theft. Are these accounts reported on your CR's? If so, how are they reported?

Either way you need to get this debt validated, see who signed the original docs and go from there. You will get plenty of very good advice here so please continue to check back on your post. Good Luck

Unfortunately, it is very doubtful that the OP will receive an original signed credit app from a JDB if GE no longer owns the account. Do you know if GEMB still owns the account? If so, and if you have disputed with the CRA's and they verified, then request an investigation with GEMB under section 623 of the FCRA. They have 30 days to respond and that should give you the information you need in order to determine if you need to go thru with the ID theft process. Sec 623 will only work if you have disputed with the CRA's FIRST. If you haven't disputed, do so now.
