I've received notice of a court summons regarding an old Cingular bill, final bill 02/04. The amount is $3400., I've read several cases of people with the same billing error situation. My question is- the phone was ordered online, in Oklahoma. We are now in Georgia, what is the SOL?

The SOL for a written contract is 6 years but the SOL for an open ended is 3 years in Georgia. I am not sure but a cell phone account may be open ended like a credit card you will have to check that out.

A written contract is an agreement made on a printed document that has been signed by both the lender and the borrower.
An open-ended account is an account that has a varying, revolving balance.

For Oklahoma the SOL is 5 years for written contracts and 3 years for open ended accounts.
