I know the fdcra does not apply to original creditors, but there must be some kind of regulation on how many times they can call a day. The payment is due on the 23rd and if it isn't made that day, they start calling non-stop on the home phone and my wife's cell phone. They probably call both phones at least 10-15 times a day. In my opinion, that is harrassment. Is there anything that can be done to stop this non-sense. By the way, I will never have a laon thru them or recommend anyone take a loan from them. They are horrible and quite honest, the customer service sucks.

Your state laws may address this issue. Some states have similar collection laws making it illegal to make repeated phone calls. Your state law probably has a criminal code that also addresses this issue.

If legal, answer every call and record it to gather evidence of the harassment.

You really cant...for the most part 1st parties are exempt from fdcpa type violations.

OP...I am assuming you are screening your calls. If you answered they wouldnt have to call back. Your account being past due is put on a dialer. Once they make contact, the account is roll out.

someone used my name as a reference without my permission, as I would never let him use me anyway.I have received numerous calls from 1-605-452-3413 asking for this man, when I tell them that I never gave permission they continue to call, I have called this number asking for a supervisor and I am told that that is not possible.JUST HOW DO I GET THIS STOPPED?

I would send them a cease & desist letter. Send it CMRRR. If they continue to contact you after they receive the letter, file harrassment complaints with the police, the AG office and the FTC.

Personally, when friends of mine use me as a ref, and if the place calls me, I have fun with them. Last time I pretended I was a lightbulb telemarketer, and told them I was so glad for calling me back, and spent 15 mins trying to sell them lightbulbs before they hung up.
