It may be that the pdl is illegal if they advised you to not call them back. The fact the collector threatened you with jail only strengthens that probability as it is illegal for them to make such threats. Don't call them back. If they call you tell them they have 5 days by law to send you a letter regarding the debt. If you get such a letter then you send a debt validation letter demanding proof you owe them.

Tell them you refuse to speak with them on the phone and hang up on THEM.

You can record phone conversations without letting them know. You also have some good consumer laws being in Texas, you can send them a debt validation letter and they HAVE to do it in 30 days. Check and see if the debt is on your credit reports because if they don't validate in 30 days they HAVE to remove it from the reports.

Also in Texas collectors MUST have a bond. I checked and there is no listing for them, so they can't even attempt collections with you.

Help! I paid H&P a settlement amount 2 months ago, only to find out that they did not note my account as settled, and sent the remaining balance to another collection agency! They lied and said the woman who handled it before was fired, but I got her VM! I don't know who to call for my legal rights, or who to file a complaint with...or even who to contact to settle this with, because they were rude and condescending (even though they were the ones who messed up), yelled at me and wouldn't answer my question of who is the owner, address, etc. Now what do I do??

I got A call On SAt. October 11,2010 told me I owed a debt for a check told me i had to pay or go to jail i payed did i do the right thing

no because threatening jail is illegal.i'm guessing also you got nothing in writing either.be prepared to either be threatened again by them,or another collection scam.never just pay because someone threatens.demand details in writing first.if they refuse hang up on them as it is a federal law that they must send a letter 5 days after initial contact.you got scammed my friend.remember this experience and learn from it.

omg! Today I receieved a call to my cell phone which by the way i have no idea how they got it, since i haven't given it to anyone!!! not even my boss!! A man told me they were putting sending my "promised Check" to a legal so and so department because Its consider fraud since i had put it as collateral and it came back when they submitted it. The guy asked me how much money i had to pay and i tod him ZERO he said that he could not help me since I refused to pay! i told him that i did want to pay but i have no money! he passed the phone to a very rude man and he was rasing his voice and told me face the consequences if I did not pay by today at 5:00 he asked me to call my mom and relatives and ask for money hahahah!! i was barely going to speak and he hung up on me :/ honestly I'm afraid to go to jail because of "fraud"

To whom it may concern; (all of us to the matter) My lawyer told me that you can not be put in jail just because you owe someone money $$$ !!!!!!! Debt collectors are violating our rights. Do not send any one a damn cent ! It's a scare tactic they are using and the verbal abuse from them is a BIG NO NO!!! Don't fall victim to their BS! But be ware you can go to jail for a STATE or FED Debt now they don't play- sorry. Also, a BONDSMEN can put you in jail (a person who post bail for you to get out of jail). There are plenty of sources you can complain to and possibly sue these assholes if you got the time- do some research or your homework.

I was contacted on 2/5 from the same company, they left a nasty message requesting my statement regarding a issue filed in their company. When you call back the mail box is full. However, are these folks suppose to call your job???

Don't worry about it, it is simply a tactic to make you worry. Send them a letter telling them to not call your place of employment. If they do after they get it, then they have violated and you can sue them.

I havnt been able to research TX laws but I received the same threats & rudeness towards my references.
Hoping it doesn't get to the workplace. I too was out of work for a recent period.
Please keep us posted to this company and the legal stand points. Thank you.

I Spoke with someone by the name Craig Lombardo yesterday. I'm from South Carolina. He called my job saying how he would hate for me to go to court and be arrested. He also gave the time limit thing, but an hour after the time limit he's still calling me for money. I was worried, but after reading the post and looking for info on HP capital for myself, I'm not worried anymore. I would love to take care of my debts, but not with threats of being arrested! I will let my State Attorney's office know about this.

I received a phone call today from a Sgt Nickleberry stating that if I didnt pay this money I would go to jail. They also stated that my account was red flagged. They said I owed 1120.00 but I told them I paid down to 840 already. Then they said I could pay the 840 but I had until the end of the day to pay it. I asked them could they send me something via email that stated once I paid the 840, everything would be over and done with. She said yes. Then I said could I pay a portion, she said I could pay 420 on monday and 420 by the end of the month. I said ok. then she called back and said suppossily the systems were down and she could not send me an email until monday. I told her I would send the payment once I get the email. I work in law enforcement so I will get to the bottom of this legally when I get to work because I think this is bull.
