Or, the more likely scenario, if you were going to be arrested you wouldn't be getting any forewarning like that. They would just come and do it!

I don't understand why CA's don't realize how stupid they sound when they use threats like that.

You need to send a written DV/C&D letter to these @$$-clowns STAT! Tell them, in no uncertain terms, they are not to call you at work. Ever.

Be sure to report them to your state's Attorney General's office, the Florida Attorney General's office, and the FTC.

And NASCAR_Devil makes a good point. You need to check with the state agency, in your state, that regulates the collection industry and see if these jerks are even licenced to be collecting in your state. I confirmed, after reading a post in this thread, that H&P wasn't even licenced to be collecting in Florida until 12/5/2008; however, I'm quite sure they were collecting way before then.

I checked on the Missouri Division of Finance Web Site and did not see them listed as licensed in the state of Mo. Is there some place else I should check?

I am not worried about being arrested, but I do intend to send the letter that was mentioned (certified mail) and instruct them not to contact me at work, but I am curious if they are even able to do business in Missouri.

Not sure Devi, you might want to check with that same department (by giving them a call) and see if they are the office that regulates CA's and their licences. I know, in Florida, it's the Office of Financial Regulation, but it might be different by states.

Also, when you're talking with them, as if they are the ones to file complaints with regarding CA's operating without licences in your state. Don't forget to file complaints with your state's Attorney General's Office as well as the Florida Attorney General's office regarding their fdcpa violations.

An agent from H&P left a message for my reference saying for me to call them regarding a legal matter. When I called back I talked to a very rude, Amanda. She said I had until 6 pm today or they would proceed with legal action. When I asked what exactly that was, she replied it's not up to her to explain, but it's more than just a slap on the wrist. She said Payday loan beleived I closed the bank account intentionally to avoid paying them and wanted to prosecute me. I was scared and shocked until I found this site. I had borrowed $1000 and am down to $445, I've been paying my obligation, but I haven't been able to make a payment since Nov. She proceeded to tell me I've had plenty of time and today is the day I'm held accountible for my responsibility! I told her I was willing to make a payment and she said she could only accept the $445 and she suggests I call my family and friends. So finally I told her I am in the process of filing bankruptcy and had my lawyers info and case number for her. She would not take it! I finally hung up on her, still afraid. I have three children- I can't go to jail. Look at this economy, my husband lost his job and I'm barely paying the mortgage. I'm calling my lawyer.

you will not go to jail.this pig can't do that.if you have the #give it to your BK attorney.try to file asap.in the meantime the old FOAD is called for if she calls back.again you can't go to jail for owing a debt.especially pdl debt.

I would call Miss Amanda back at exactly 6:05 and ask her what's going to happen now?

Of course, I've been told I'm an @$$-hole at times too.

It's also illegal for a CA to suggest you incur more debt in order to pay of the debt they are collecting on too, isn't it? Like suggest you borrow more money to pay them?

You know, I should be amazed, but I can't say that I really am. There have been more postings regarding H&P Capital in the recent past than I think I have seen about any CA.

Is it just me?

These people can't arrest you, this is a civil case. Tell them to go ahead and send the cops...I bet no cps would be showing up. They want to call you at work, tell them to go ahead, let your co workers know these people are fraud. Who's shit don't stink in this world....

I will be talking to someone from the Missouri Dept of Finance today, I e-mailed him and he set up a time for a call. I will be filing a complaint. I was also told by them to borrow money from a friend or a relative. According to Mo law a payday loan is not considered a "bad check" and is therefore a civil matter, unless it can be proven that the bank account was closed before the first payment was due.

I sooooooooo want to call these people back and tell them what I know about them and how I feel, but I don't think that would be a very good idea.

I got a call from Stacy Boyd today and she pretty much told me the same thing as all of you. I told her that I was consolidating my pdl's and that the company that I was working with would get in touch with them. She told me that they would not accept the money from that company. Which I know is a lie. If they are trying to get money out of you and you don't give them any, they will accepted it from anywhere. She told me that same crap about me getting arrested on my job and I told her to bring it on. I have had several collection agencies telling me the same thing and I just tell them what I told Ms. Boyd. They just want to get as much money as they can and they get a percentage for collecting. They were pretty harsh with me too but I was pretty harsh with them too.

I've given up keeping track of the names of the people at this company that have made it into posts on this website. I'm sure they're all alias' and they change weekly, daily, or even hourly. I do think, however, I have seen the name "Stacy Boyd" here before.

Oh yeah, and I'm willing to bet it's the same people (meaning owners) still in control of H&P Capital. They just made a few changes on paper to try getting out of the ton of lawsuits they had pending against them.

I have to say, though, i requested copies of their application for licence from the Florida Office of Financial Regulation and all the names are different on both applications. So at least they were smart enough to get that right. Ironically enough, though, and the guy from the OFR mentioned this, both applications list the exact same address and phone numbers; however, I do know the phone numbers have since changed for H&P Capital. It's no longer the same as LMP.

Still working on a fax number for them, though.

Guys, I can't stress this enough! You need to file complaints regarding this company with your state's Attorney General's Office, the Florida Attorney General's Office, and the the FTC! Nothing is going to get done about this, or any other CA that breaks the law, if enough complaints aren't filed! The agencies I mentioned have to see a clear pattern of abuse before they act!

i have their fax number in my husbands truck when he gets home i will get it we were told to fax our debit card and a drivers license to them, which i did not, we dealt with reid i think was his name what a arrogant guy, i havent heard from them in about a week,

They called last week and left a message stating that a decision was being at the court house about me and good luck. I called back and spoke to a Wynn Bom whom set up a payment arrangement with me. However any Amy Bishop keeps calling me and threatening me. I called back today to make sure I had the correct info for the payment. The guy whom spoke to me stated he was the owner and that I had never made a payment plan. I asked to listen to the recorded call and he yelled stating your telling me what I need to do, you need to pay the entire balance and kept yelling at me. I think we all should do a class act law suit. Let me if anyone interested. Yes I did the loan and became disabled I had asked the company for a payment plan and no one wanted to do that.
