I received a threatening phone call from an H & P Capital today at work. They said they're contracted by Web Payday, that I owe $1,800, the $1,000 I took out plus fees. I had closed my bank account and was working with a PDL consolidation group that turned out to be a rip-off, so was trying to resolve this on my own. These people were VERY abrasive, and said if I didn't pay they would have me embarrassed at my work or home legally and arrested. Can they do this? They want me to make arrangements to settle by next week and fax my dl/debit info to them. They refused to make arrangements for payments and were verbally abusive. Are they legal in CA? Can they have me fired or arrested at my work? I'm freaking out and need help now! Please?

Hey

Dont be alarmed like I was. Do some searching the internet, there are several people in this like you are. Whatever state you live in, find out the laws there. This place hopefully wont be in business long, especially with all the complaints. I am not sending any money to them. If I'm not mistaken, they cant arrest you for failure to pay back a payday loan. If that was the case, half of the country would probably be in jail! J

It's funny - I was researching this company to get information of what type of collections they do because I have an interview there today. Now I can see them collecting for unpaid debts but the "Good Lucks" and the rudeness is unacceptable. Going to question them on this when I get there. I believe in being nice - so your not seen as a phony company and get paid (that is..if they are legit) Ill get you posted

What they have done is illegal. You can't be arrested for not paying a debt. You should send them a DV letter immediately and make them prove up all those 'fees'. $800 in fees seems excessive to me.

Well I went there for my interview, its all commission. No wonder people are threatening, they could loose their jobs if they don't reach their quota. I turned it down, plus the place does seem a bit sketchy to me and they hire sketchy people. I witnessed someone paying their debt - and it took 30 mins before they found the right person to pay their debt to and then the guy was giving them a bogus excuse.

i'm in this similar situation Satcy Boyd called and stated that there was a filing out of the city that i live in, & that they had to get a statement from me that very same they they called by 2pm. it's not that im ignoring the situation but times got hard, & i lost my job. yes they are very, very rude.I've also received another phone call from this character by the name Rick MooreHouse #904 672-1023 ext 282 stating that they needed to hear from be & that it was imperative that i call him because of the charges against me that are being filed & that if i do not reach him he would hate for me to be blind sighted by what tis going to take place against me. and yes the do say(BEST OF LUCK) LIKE WHAT THE HELL... and one lady yelled at me and said it's my choice either pay it!! or go to jail... they have also called my 1 of my reference & has been rude to them.. remarks like" oh palying hide and seek i see?" and now finally i have seeked advice and also help.. i would like your feed back. truely yours" not ruffled"

Totally illegal. Check your state laws about recording and record them. Heck, if you have to disclose you are recording you should say something like:

"Ok, I am now recording our conversation, can you tell me again how I am going to be arrested and go to jail?"

If they give you any lip about it, call the bluff, "Oh..so why won't you go on record saying that? because it is illegal..that's why!"

first of all, you should check with the state of florida about H & P Capital. They just incororated as of 10/14/2008. Secondly, they are in the exact same address as Legal Mediation Practice was before they dissolved effectively on 10/31/2008. Next, check the website.. www.flofr.com ( office of finance regulation ) and you will see when their license to LEGALLY collect on consumer debts went into effect which was on December 5, 2008. So, if they were contacting you prior to that date I would say they were operating as a collection agency illegally in the state of florida. Also, you will note that the address and phone they have on their license is the identical one that is for Legal Mediation Practice. This concerns me greatly since Legal Mediation Practice dissolved as a corporation as of 10/31/2008. Folks, gather your info and start sending in your complaints to the AG of Florida to have this company investigated. Also send in yout complaints to the FTC. I will be interested to hear from anyone else who has done any research or from the bottomfeeders themselves to see if they can justify, which would be funny since I have done my homework and have found out all the info I need to proceed forward in making sure thye are not allowed to use scare tactics against consumers. Enough is enough.

we had a experience with this company yesterday afternoon, needless to say they were not exactly NICE. threatned my husband with jail this morning at work, to the point he was ready to call in sick. my husband doesnt remember doing it and the same month they claimed we did it is the same month that our checkbook got stolen, it scared me when they told me and i am not even on the per say loan but they said they have more information on me than i know on my own self. i am thinking seriously on making a complaint with the BBB this morning, i asked them if they could prove that it was my husband that did this loan and they claimed they wouldnt have so much info on us if it wasnt him that did it....

I just received a call from them also. Mine is actually that I recieved a counterfiet check and the company verified it thats it was ok and gave me the money. Later on I was contacted and informed it was a bad check. I immediatly freaked out and retained an attorney. I continued to recieve checks for a period of time and gave them to my attorney. This H&P Capital called stating that I have two days to pay the money without contacting my attorney and also told me that I would be arrested at my home in front of my children. This company is a scam artist and I have given all there info to my attorney. Hopefully they don't stay around to much longer. The next person may be scared in give into them.

OK guys, I did a little research because this posting really caught my eye.

I called the number "NOT RUFFLED" posted, 904 672-1023, and talked to a woman there. I asked her the mailing address and she tried being evasive about giving it to me. I told her I was looking at it on the "Florida Office of Financial Regulation" website and read it to her. She said that it was correct.

I then asked her if they used to be called "Legal Mediation Practice" and she hemmed-and-hawed about it telling me they were not. I asked her what the name of the owner of the company was and she wouldn't give it to me. She then asked me to hold and, somehow magically, I got disconnected.

My guess is, this is the exact same company and the same owners, just a newer and better name. I left messages for two people that I was transferred to, when I called the FLOFR, so I can find out if the owners of the company are the same.

I'll keep you posted.

I'd be willing to bet, though, they are the same and this is just Legal Mediation Practice operating under a new name and trying to avoid the lawsuits that were pending against them.

Don't let them scare or intimidate you at all!

OK, I finally found both of them on the Florida Department of State website. The names are different under the "Officer/Director Detail" section. So I can only guess there are two different owners? I've never had to look this far before, so I may not know what I'm looking at.

I'm willing to bet, however, it is still the same company employee-wise. As evidenced by the same scare tactics used by the two.

It will probably only be a matter of time before H&P has to close down too, due to all the lawsuits they are going to start racking up!

i felt compelled to come back and post again that they called and harrassed my husband at work yesterday saying that we had till 300 yesterday afternoon to get the money in there again, i called them back, and when i got on the phone with them i called their bluff concerning the going straight to jail threat, i told them that by law they couldnt do that, he seemed upset that i told him that, and he came back and said if we hadnt screwed up and paid our debt my husband wouldnt be facing jail time... i just kept my cool and told them that they were breaking the law, before i hung up on them i threatned them with a lawsuit they seem to see my way about things then, i still want to see a lawyer about what they have done! now it is only 1230 here, and i havent received a call yet, but that doesnt mean anything... whats a day this week without a harrassing phone call... thank you for this page so i know that i am not the only one going thru this... please if anyone has any other contact please email me at morrow41999@hotmail.com,

I got a call today stating that there is a red flag on my social security number and drivers licence. They also told me that they would come into my job or home. I spoke with a Miss Harris.

typical bottomfeeder lies.a CA can't flag your ss# or drivers license.they also can't have you arrested for owing a debt.this does sound like LMP all over again.
