At the end of January I took out a pdl with Authorized Payday for $300. I paid $90 for the next four paydays - totalling $360. It was at that time I came upon this site and realized 1)They are not licensed as a payday lender in California which makes them and their agreement illegal. 2) They do rollovers which are also illegal in California. Since I paid the principle and over the legal interest in California, if they had been legal, I stopped paying them. Sent the appropriate letters and reported them to the BBB and Dept. of Corporations. They turned me over to a CA - NCA. NCA sent me a letter and I sent a letter asking for validation. OK...here is the strange part. They sent me back one sheet that has my name, address, loan amount, app date, orignation date and my eSignature history...basically the date of my Esignature. That info. is all correct. Then they sent me a copy of the loan agreement..The loan no. is different, the date is 4/5/07 when my orig loan date was 1/27/07. Their address is different. The loan amount is different. Everything is different. I was thinking maybe they redid the loan after I stopped paying, but on the second page they state that they deposited $250, which they did not and I have proof. They have a eSignature on the last page, which I am sure they could have typed in. Are they trying to show what is still owed on the account or is this fraud??? This seems very wrong to me.

This is an illegal tactic. First of all, they are operating illegally due to lack of license, and again, allowing roll-overs in a state that does not permit it. I would simply file an online complaint with the attorney general's office of the state where the company is based. Just google the AG office for that state, and it will have a link: consumer complaints or file a complaint'. Fill out a quick description of the events, as you did here, and let the AG handle the rest. Do not speak to the loan company again.

Should I reply to NCA that this is not an accurate validation of my debt and why?

I would not talk anymore to a company that is violating federal laws. Simply place the work in the hands of the AG.

Do not speak anymore to this company or send them stuff. It can backfire on you. Let the powers of law do the work for you.

I dealt with NCA earlier this year for an ipdl with plat B. services....Lisa Ray called in Feb of this year and told me I too had committed internet fraud. I paid several roll-overs which are not allowed in my state. She wanted $ 570.00 on a 250.00 loan and I had paid back over the principal amount. I filed complaints- send letters certified- never heard back from them. NCA has not responded to 1 complaint that I know of...They are SCUMS! Follow the advice here! Razz

I am doing a little research. I just found that NCA is a member of the BBB. Suddenly, I don't have a lot of faith in the BBB.

The better business bureau simply is not informed of the wrong doings of certain companies, unless consumers file complaints.

Oh, I know. I just thought with all the complaints I have been hearing about this agency, that they would have complaints against them with the BBB. Perhaps because they tend to violate fdcpa, most of the complaints are filed with the AG and FTC.
