I need help my grandmother is scared that they are going to put her in jail for a defaulted payday loan. she is 89 and only gets her social security checks. Any advice?

Tell her that they can't put her in jail or do anything to harm her. Tell her not to speak to those people and just hang up when they call. Is this a storefront or an internet loan? Please tell me what state she lives in. How much she borrowed and how much she has paid so far. What is the name of the company. We will do everything we can to help her out of this. At her age she should not be scared or worried. It is not good for her.

My granmdother got it from Ace Cash Express in the State of California (walk in) $255.00 plus fee (300.00)and has been unable to pay it back yet. She needed it to pay her PG & E and I am trying to help her the best I can but have a disabled husband to think about... so any help you can give is appreciated.

Has she called or gone there and tried to make arrangements with them? Hopefully someone from Calif. will be along shortly with knowledge of how they do things there.

No we aren't taking any phone calls except this one because they threaten her then her bp goes up and she is going to be 90 in november.. im so sad..

Please don't panic. First, be sure that the CA is following the federal laws on collections? Have they validated the debt in writing to your grandma? If you are not sure, read the FDCPA laws and know of your consumer rights. You can enforce it on the CA and make sure that their collection practices are legit.

This would still the original creditor she is dealing with, so the fdcpa wouldn't apply to them. At least until the debt is sent to a third party collector.

I would also call your state's DFI (dept of financial inst.) File a complaint against this company. Since they are a storefront they will most likely be licensed and can be punished by the DFI.

Sorry, I missed where it says leagl mediation in the title! Duh, that is a 3rd party collector.

And they are a really bad one. You need to file complaints against them asap! Ignore any of their threats or calls. They cannot do anything to touch your grandmother. They are the scum of the earth.
