Yikes! Vegore, simmer down there tiger!

I think you're venting in the wrong forum. Sounds to me like you want to be talking directly to John Frye or his representatives. None of us here are affiliated with John P. Frye in any way.

This is a forum that helps people being victimized by crooked CA's, and offers advice on getting out of debt. I can definitely understand your frustration if you have been victimized by John Frye.

As for comparing him to child ****? I would think most of us would agree that's really a stretch. Yes he's breaking the law by harassing and abusing debtors; however, I don't think that's as heinous a crime as child ****.

No, I think the act of production/distribution of child pornography should be a capital crime.

I am currently dealing with this law office/debt collector.. And I don't know if i'm just one in a million but, the woman I am dealing with there (although it took me rounds of phone calls, number finding, and a while to actually get a hold of someone- then her) is probably the most pleasant AND helpful debt collector I have ever dealt with. She is patient, understanding, and willing to help me get the least pay-off settled amount that I can (my debt was for a loan of 4000, and I am probably going to have it taken care of for less than half of that- which is GREAT in my opinion). She did the back-and-forth with ACF, the company that my loan was placed with, and answered any questions I had helpfully- even the repetitive ones. Any other creditors I've spoken to have either been unprofessional or rude, impatient or obviously money-grubbing. So far, my experience with these guys has been a breath of fresh air... Or as much of that as dealing with debt can be.

volenti non fit injuria and unjust enrichment to john p frye. He risked his own money buying debts. say a $2,000 he paid $160 for. Then he trys to collect interest on top of the $2,000, say $700. he just made $2,540. That is unjust enrichment.

As for volenti non fit injuria, He took a risk and therefore can not sue over that risk.

Most he can sue for is what he paid for the debt if that. So tell your wife who works for him to stuff it.

I just was contacted by John Frye for a debt, I don't know from whom but can't I wait for something in writing to come to me even before I call them back. Can they garnish wages or will I be able to work something out, I am a single mom who went through a divorce and I am just trying to get back on my feet.

They can't garnish your wages without a judgment. That would mean they would have to file suit against you and win. They are not required to mail you anything until after either A. Within 5 days of initial contact with you they must send you the standard dunning letter or B. You request validation of the debt in which case they must cease all collection activity until validation is produced.

What are these people? I have recived no letter in the mail or anything or even leave me a message on my cell phone. Even when a friend called for me they didnt leave give us information as to what it pertained too.
I was told to be careful in the 1st place cause it is a scam. From 2 people. Offical offices send notices and not beat around the bush.
They better check again because I paid off my payment on the last day.

We received a letter today from Frye Law office in Va. I called right away to try and find out what this is and why I never heard from Atlantic Credit. HSBC sold our account on July 25. We do have an amount owed and were making payments with CRI, the collection company. Then it was sold last week. Long story, yes we want to pay. It is a debt. We've had a rough year, gone through numerous loan apps to get the $ and denied due to current status. Now, this company said they don't set up payment plans. If I could pay 50% today then they would try and work something out. I'm in this situation because I don't have the money, obviously. Sometimes things happen and I've heard the whole "your a scumbag, low-life, who should pay their bills... blah, blah" I'll tell you, for 12 years we had it pretty good and then one thing changed and changed the course of everything. Now everyone in the credit world wants money and wants to tell me how "crappy" I am .. hello, the past 12 years, all we got were "praises".
Is this company legit? The secretary male said that they are preparing to send the account to an attorney in Pennsylvania to sue us for the money? Is bankruptcy the only option? We've tried to avoid this avenue but it seems the only avenue left? Any advice is helpful. I don't need the CA people on this blog to tell me what a low-life I am .. everyone has a rough patch .. this is ours. Thanks

Welcome to the community Baby Girl.

I understand that almost everyone comes to point in their life where things seem to spiral out of control, it doesn't make you less of a person. If you could please answer the following questions I'll try to assist you as best I can.

1. What type of debt is it?
2. When was the last time you paid on it?
3. What state do you live in?

It is a Mitsubishi credit acct through HSBC, last payment was made to CRI (collection for HSBC) in amt. of $600 May08. We stopped making the payments of above because they sent us letters within 2 days of each other stating to pay up 2495 that month and every month thereafter or HSBC was sending it to charge off. Then the following week we got the notice to pay the 600 fee we agreed to. I tried to pin down the collection company to put in writing that they weren't charging off if we sent the 600 because of the previous 2 letters; it was all conflicting information. They wouldn't and we didnt' send $. We couldnt pay almost 2500 ea. month?
Sorry, little background. Now it is with this Law Firm Guy? We live in PA. BTW, ea. month we made what we thought was interest free payments to CRI, HSBC sent a statement and the $ was only paying interest. Trust me, we want to pay the credit card account but no one can set up payments.??? Now a lawsuit? HELP, I am going nuts trying to get this resolved and thanks for being kind. We are good people who had a situation change.
