John P Frye Law Office ripping me off, what can I do to get out of it?

John Frye does have a bar license in VA, if you need to see for yourself vist MARTINDALE.COM, you can find his bar # below. John Frye can & does sue in the state of VA, they will send the debt to an atty in your state (as you can read in some of these postings, it does happen). Yes they do purchase YOUR bad debt for less, but come on, YOU spent the $ so YOU owe every penny, even the extras you signed up for (interest, late fees ect). I don't know why people cry about the phone calls you get (I get them), you owe $ for something you took home & enjoed, you did'nt pay for it, now you want to complain! I know it is annoying, but you have to own up to your responsibilities & pay the debt. Everyone in the US is going thru the same economy problems (including me) (high gas prices, mortgage, car, food, kids I can give every excuse) but I have to pay my bills also! All I am saying is, this is America, you borrow $ you have to pay it back, Lets stop trying to run from it & deal with it. The law states that they can call our jobs until we tell them to stop, they can call us 8 times a day or even more, they can ask where you are & try to find you, they can demand full balance to be paid because you defaulted on a contract that you signed, that I might remind you to read the fine print, that said full balance would be due in full once it has it has been defaulted on! I'm almsot certain that once you send in a C & D letter, red flags come up in the office of John Frye, & most likley your debt will be sent out for suit, which I should remind you again, he does'nt have to practice in your state to sue, as long as it is sent to an atty within his network (which they have in every state). So lets be up standing citizens, be adults & pay for you bills, I don't want to pay higher taxes because you are trying to find a way not to pay! Now I'm going to talk to my creditors to get them off of my back!

That is all fine and good, but where is your pretty speech for when this Frye collects on bogus debts, or illegally adds interest and fees (that were NOT in the contract) or even just trying to collect upon debt that has already been paid?

I am so sick and tired of hearing 'pay your bills' and 'you took money so pay it back'. It is getting so very old. Where do you even get that we don't? Where do you see that anywhere on here? The majority of these posts are about dealing with collectors who act illegally, and for debts that are NOT owed. So how do you translate 'not my debt' to 'I don't want to pay my debt'??

I wish you guys would read these posts rather then just skimming them, then maybe you wouldn't sound like such a moron.

I was going to point out the sames things myself GoldenBast and PaulMergel, but I figured it would just be a waste of energy. The "Pay Your Bills" weasels that come on this site obviously don't read any of the posts on here.

Or, more likely, don't comprehend the posts they do read.

In the year I've been coming to this site, I have never seen a serious posts from someone advocating not repaying a debt that really does belong to someone. I have, however, seen posts advising people how to deal with CA's harassing them endlessly, violating the fdcpa, filing frivolous lawsuits, making a travesty of the legal system, and even trying to make people pay off debts that do not belong to them or are overinflated.

I could be wrong about this, however, so I'd like to challenge Tabby to locate a post from that seriously advised someone not to pay a bill that belongs to them. Please.

As for whether John Frye is an actual attorney, or not, who cares? CA attorneys break the law (the FDCPA) just as much as regular CA's. I think there was a link published in this particular thread that leads to information on John Frye being sued for FDCPA violations. Personally, I have never had an experience with John Frye's office, so I can't say one way or another how his staff behaves. You can bet, though, if I did have problems with him or his staff (IE FDCPA violations) I would certainly make them known on this forum. I would probably sue them too, depending on how egregious and numerous the violations were.

But, again, I have had no personal experience with his office to date.

I might suggest that you do so, Tabby, and stop coming onto this website posting your "one-size-fits-all" reasons as to why people cannot or do not pay their bills. It might be energy better served getting yourself out of your own financial mess.

BTW, why are you behind on your bills? According to your own post, you just do not feel like paying them? Just trying to avoid your responsibilities? I just find it amazing that anyone with debt problems of their own would come on here trying to browbeat others. Must be trying to sooth your fragile ego and feel better about yourself by putting others down.

No, I do pay my bills, I do fall behind (who in this world does'nt), I have no credit card debt beacuse of things like this (I own not one credit card !), I have emergency rooms bills, I have fallen behind on my electriity, However I suck it up & pay (I talk to the peolple & get things taken care of!!) I just have a problem with people who say John Frye is'nt a real atty or his people are all beaking the law, yes prob. a few do, however what company does'nt have problems! I just have a problem with things such as this. I don't have credit cards or credit, because I know I don't have the $ to pay it, so I made the decision not to get things I can't afford! If I fall behind I get a second job, if I get behind I find a way to pay, I don't bash the people who are calling me trying to collect on a debt that I owe. I know from doing my resaerch that Atlantic Credit buys bad debt (that people have defaulted on) & places it with Atty John Fryes Office to GET THEIR $. I do know that their are NO fees that are added once Atlantic Credit buys it, it is all interest & late fees from the person not paying the bill. If people would take time to do their research, I have read on these things, you would find this out yourself. The law suits he has had against him has been from his collectors violating the law, NOT by adding any illegal fees or interest (by the way if U have paid the bill, then U should have a letter showing so, that would prove that U paid it, just send them the letter & get them off your back). If you do find a law suit stating that he is trying to make someone pay a debt that is fraud or added any illegal fees to it, find one PLEASE post it & let people see the REAL truth!.....Paying a debt that does't belong to them as above has said.... I have read many on here of how to get the calls to stop or how to send in a letter so they can not contact you... (ex: They can look at your credit report if they are collecting and they do to get information. Don't talk to them on the phone, simply tell them to expect your letter in the mail and hangup. Send them a DV letter with a partial cease & desist, basically telling them they are no longer to call you at all, that all correspondence will be through the USPS. by goldenbast) what is that called .... avoiding the issue that you owe a bill, or pro longing the situation, if you really feel that you don't owe the bill then yes send it, but don't use it just as an excuse....again please find a REAL lawsuit where he has sued or tried to collect on a debt that has been fraud or illegal fees added.... The atty thing, whether he is an atty or not, there is a post or two on here stating whether or not he was a REAL atty,(ex:I just called the Virginia state bar and John P Frye from Roanoke is not a lawyer. what is this called ....not wanting to pay for what U spent...Who cares what they paid for the debt, you walked away with the merchadise knowing what it cost, signing your name stating that you would pay for it along with their interest & fees, also that you would accept FULL responsibiltiy if you defaulted, so why should you not pay the full balance, that sounds to me like "Stealing".."Wink Wink" threatening BK just so you don't have to pay for what you said you would!!...I will wrap it up by saying "I feel as many Americans do, this is a country where we have the right to borrow $, all I want to see is people pay it back" I will say "if you don't like the collection calls, pay & get them off your back" Keep sceaming & trying to find ways to place the blame elsewhere, I don't have time for this kind of behavior" Enjoy yourselves!!!!!

Yes I got many calls from John P Frye Lawfirm. I believe it is a fake company set up for Identity theft. They asked me not only for my bank account number, but my debit access code. I am speaking too my lawyer about it. He also herrassed me even though I was setting up a payment plan. He used foul language and brought up my car payment which he said was a thousand dollars when in all actuality it is only 500 and he then began too downtalk my dad for not paying off my credit cards as well as my car while I am unemployed. If it is a lawfirm in deed they are conducting thereself in an unbusiness like way. Not too mention they got a phone number which is not registered too me. So not only do I feel necessity too take legal action, but the people whom he has offended and reached are talking too lawyers as well. According too a news website they have had in the past 3 years over 100 lawsuits against them.

Yeah I agree if I'm agreeing too pay why does your lawfirm continue too too be rude with me?

It is very simple-call his Mechanicsville office and speak to the "real" attorney, Michael Katzen.

Here's how it works-Katzen does the real legal work, Frye diddles the debts. Katzen has had it.

In Roanoke, the "law office" is colocated with Atlantic Credit and Finance. No lawyers there. The only lawyer at the Law Office of John P. Frye is Frye himself.

Tell Katzen he's looking at yet another bar complaint. I did this, he settled for $500 on a $18,000 debt. He knows his license could be taken away for the crap they pull.

And yet Tabby, you still seem to lump it all together.....you are forgetting the one fact: People have the RIGHT to full validation, because it has been shown over and over again that these companies DO charge more interest and fees then is legal, or try to get people to pay using tactics that are downright illegal. You say that if you paid a bill, send in the letter...well what about those debts from 5+ years ago? No one keeps that kind of paperwork around, do you? It is a simple fact that the burden of proof is NOT on the debtor, but on the one trying to collect...they HAVE TO, BY LAW provide the proof. If they state that the interest is legal and in the contract, then they dang well better produce this so called contract. I don't know how many times I have spoke with collectors (and yes, one from Frye office as well) on a couple accounts that were questionable. I asked for the paperwork that is my right and yet they can not provide even a shred of proof. Of course I am going to tell them to stop harassing me. And I do sue them for these illegal practices, and I win...so there it is there.

Let me ask you, you say that you pay all your bills...so you also pay those bills that you personally find questionable? Just any old shmo can can call you up, demand money and you run right to your checkbook? Must be nice to have money to burn like that.

Before even talking too a debt collector look up a law called the fair debt collection practices act. Make sure he has a surety bond that he has filed with the secretary of state too legally ask you for money Take John P Frye for example since he is a 3rd party lawyer that may not be in your state his office is in virginia. He represents a bank that purchased an account after it has defaulted he is not the original creditor, which he even states that the original creditor no longer has interest in your money. He is in no position too threaten you with an arrest or state that he can sue you himself,or use innacurate information, or even use foul language which he used with me, and also interrogated me about my dad and provided false information about my car loan which all 3 are against the fair debt collection practices act which was instated in 1978 too protect people against firms like John P. Frye.

Quit calling this # April Roberts does not live at this # QUIT CALLING NOW!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
