30 days to comply

I was recently sued by a debt collectors attorney. They dropped the charges and I got a judgment of dismissal from the court. This debt has not been proven to be mine and I am thinking of sending the debt collector a 30 day demand to remove themselves from my credit report or I will file a lawsuit.

I did sent a DV letter almost 30 days ago but they are still reporting on me. They are charging 18% interest when they don't have the original contract and the max in my state is 12%.

Do you think I am being too nice by giving them 30 more days or should I just file the suit and not even warn them? I am suing both the debt collector and the attorney for FDCPA violations so can I sue each of them at the same time for a total of $2,000?

I'm pretty sure it was established in this community that you can only sue for up to $1000.00 for a FDCPA violation, but if they violate the FCRA you can sue up to $1000.00 for EACH violation.

I would probably just sue them, why give them a break, sounds like they didn't think twice about giving you one. But that's just me. Smile

three times is the charm,sue them.nail them to the
wall,as shazzer said they wouldn't cut you a break,
why then give them one?

Also remember that them filing a suit while a DV was in effect is clearly continued collection activity. You should also dispute with the CRAs and when they verify, you have have them on 3 more violations! That is $1000 for the FDCPA violations and $4000 FCRA violations just off the bat! (You likely can get them on more violations).
