Can a collection agency put a judgment against you when you have been paying the amount you both agreed on? I have never been late on a payment and it is always a week early.

I would think that they cannot get a judgement against you if you both agreed upon an amount and you have it in writing.

Also i'd think that if u were indeed making any kind of reasonable payments to them they more than likely would not try to get a judgement on u.... I think they're better off getting the money they're getting now than to take a chance of losing a suit! Now of course i'm not saying this is 100% definate answer but makes sense to me...

If you have been paying them an agreed amount and have proof that you payed it, like your cancelled checks, they would have to be idiots to walk into a court room.

Can a collection agency legally garnish your check from an old unsettled account? I don't deny that I owe SOME money, but not what they are asking for. Today I received a letter stating they would garnish my paycheck. Mind you, it is not the company that I owe the money to offering the threat---it is the collection agency.
Is this legal.
Please advise if yu know.

Can a debt collection agency garnish your wages legally? I do have an unsettled account, but not the amount they are trying to garnish my check for.

Do they have a judgement against u? Unless this is a student loan they must first have a judgement.
And yes a CA can and do file suit against u.
