Hello I am new here, glad I found this place. My name is Derrick and I am from Alabama, in 2004 I broke my back and now I am disabled. I got a call from Burgess or burjess law office that told me I ow 1,244.00 on a credit card from 2003, I dont remember that so I aske if they would send me something to validate that , anything such as a contract or proof they are to collect but they want, I explained that I am disabled and had lost my home and cars and well, everything I had. Iam on disability.well of course they dont care and he told me to pay it or make payments or get sued, I said I will be glad to arrange to pay if they would prove I owe that. he said no and if I dont pay by Friday the 30th of Nov. they will sue me and take my disability. well I dont know what to do now, I borrowed a recorder because it is legal in Alabama to record if you are involved in the conversation, but I am lost I do not know how to handle this, will you guys steer me on what I should do? You need to mail them a debt validation letter by certified mail. This needs to be done immediately. I will pm you a copy of a validation letterthat you can use as a guideline to write your own to your situation and state.

If you income is protected by definition they made a illegal threat. Most disability income is protected from garnishment. Send them a dv letter certified return receipt mail and if they sue,be sure to file an answer in the proper amount of time.

Cajun is right, retirment, disability, and most such benifits are exempted from judgments. However, once that money goes into the bank, they might be able to get it.
