Good morning all,
Looks like Allied is now in line for potential legal actions also!
Have recieved 2 phone calls from them, one yesterday and one about 20 minutes ago.
A DV letter was sent to them on March 2. Also stated that phone calls were NOT acceptable and that they were to contact me in writing, via USPS only.
Yes, letter was sent CM-RRR. I guess one last letter stating they are in violation of the fdcpa laws is in order. Even though it probably won't do any good!
Calls sound as if the MIGHT be automated, but doesn't sound like it. Could be wrong. Usually am!
Again, information on how I should proceed from here is appreciated.
Thanks

Keith, before you do anything legal, consult an attorney who deals in fdcpa and FCRA violations lawsuit. Do you have the recording of the phone call? You need a proof of their violation and make a point in front of the judge.

They call in the middle of MY night, so I don't have the time to gather what I need in order to record a useless phone call. What I DO have though, is the date/timke they called, plus copy of DV letter, green Return slip and proof of mailing.
I rarely answer calls, and unless I know who it's from, I don't return calls either. If a caller can't leave legitimate information I can't return call.
Plain and simple. But then, that's how I do things.
