I have an old debt, in March got sold to Midland Credit- I asked for validation- with some letter back asking ME to send all info I have on the debt (I did NOT send anything). THey did not validate the debt- and now continue to ask for money, and are still listed as a negative on my credit-

Here's the catch, I can't find the reciept for the certifited letter I sent (I know how important this is and have no idea how i lost it)..But I am going to try to send this letter to them and see if I can get them off my back

Does it sound OK- is there anything I should add or take away?

To Whom It May Concern:

This letter is being sent to you in response to a recent request for payment to your company. In early March (3/21/06), I sent certified letter, (which your company signed that they received) in which I asked for VALIDATION of my debt. You company failed to provide me with validation.

Please note that your company did not validate the debt, the debt is out the SOL and I am no longer legally responsible for that debt. Please note that any further attempts to collect will violate the fdcpa.

I am again requesting that you remove the invalidated information for all of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion), as it constitutes fraud under both Federal and State Laws. If any negative mark is continued to be found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:

• Violation of the Fair Credit Reporting Act
• Violation of the Fair Debt Collection Practices Act
• Defamation of Character

I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.

Hi Krista, I think you did an excellent job with this letter. You could write a 'SECOND' letter asking for validation in this case...but I feel you have done an excellent job in covering this. This would afford them the opportunity to provide you with validation at this time, since they have not done so thus far but also you are letting them know where you stand and what you plan to do. I would send it just as it is. great job in my opinion! shirley
