I recently had a judgement from wolpoff and abramson vacated. They lied on an affidavit. They said that they served my nephew. I only have one nephew and he is 1 year old. Can I sue them for damages.

I believe you can but lets wait for someone with expertise to come along! They should be reported to the State Bar!

If you read here it appears that reporting them to the state bar is a waste of time!

W&A are a very strong company. I will tell you that if you were served you must find out what addresses you were served at. Then at that time if you knwo of people liveing there they could have posed as a family member ( dont say that it wont or wouldnt happen it does) If the debt is legit resolve it or your headache will grow into a migriane. I will tell you I have done collections for 7 years and alot of companies will settle but be prepared to pay it then and there. GOOD LUCK

Yes, if you can show damages, you have a cause of action. I'd consult with an attorney.

These people are relentless and sick. Even after I proved in court and the judge found in my favor, they were still able to re-file and garnish my bank account. Now they are sending me late fees even after they collected, on something I never owed. I don't know why they are not in jail and how they are able to sleep at night.

When they refiled, were you served a civil complaint and summons on the second time? Also was the original case dismissed with prejudice or without?

Good catch uncle. They can't apply anything to a garnishment. Once the court says "you are awarded x money" that's all you are entitled to through that judgment and that is all you can collect on via lien, garnishment, levy, etc.
