I had a MBNA cc that had a 11k ballance, I started using Superior Debt to consolidate my debts, well MBNA didn't want to play so they finally sent it to arbitration, I lost that, then it went to court where I had to agree to pay the debt. They MBNA lawyer gave me a number to call to make payment arrangements, when i did we agreed upon me paying 2k upfront and then $200 monthly payments. Well after about 4 months of this, I get a phone call from a different guy at Mann Bracken telling me they want to make an offer to let me pay my debt off for $7000. Of course I don't have $7000 so I'm actually in the process of getting my house refinanced to do so.
But now he's pressuring me to make additional payments on top of the $200 a month, telling me that the $200 a month payments were a temporary thing? I had no idea it was a temporary thing but I also do not have any paper work from them stating what my payments were to be and for how long?
Is there anything I could do? or am i just screwed?

Was your payment arrangements in writing or court ordered.The answer can help us determine which way to go with this.

No, the court only stated that I owed the debt. The payment arrangement was made over the phone with Mann Bracken.

Then you have no proof of a payment arrangement.The best way to resolve this is to motion the court asking them to set a court approved payment plan.It will be legally binding on you & judgment creditor.

Ok, if I did this, what would determine the amount of the payment?

Submit a budget to the court showing what is made & what is paid.Your amount would be calculated from there.

Hello-
Before the merger with Mann Bracken LLC, I had and continue to pay my monthly paymnets to Wolpoff & Abramson, LLP. I have not receive a statement of any kind with would indicate the breakdown of my monthly payments and my currect balance since May 2008. I have been trying to call the numbers that are on the last statement that I received and I am getting no where. I smiply want to know my balance. What can I do?
