Today I received a call from a man at MCM who was rude, made racist remarks about Americans, and called me stupid. When I hung up on him, he called me back. I asked him not to call me but instead mail me, which are my rights by law, and he responded that since I was breaking the law why should I have rights? All attempts at getting his name failed, and when I told him it was harrassment, he mocked me.
I spoke with his manager who said he'd "coach him through how to talk to customers", but I doubt it.
How do I handle this?

Send MCM a DV letter and include a "Cease and Desist" request in the letter. That way, you will stop them from calling you but they may still contact you via mail.
You can do a search on this site for MCM or midland credit management and see the problems others are having with this company.
In case you don't have their address, it is as follows:
Midland Credit Management, Inc.
8875 Aero Dr. Ste 200
San Diego, California 92123-2255
Phone: (858) 309-6970
Fax: (858) 309-6977
Web Address: mcmcg.com

Your rights as a consumer are mentioned in the FDCPA. Make sure that your letter is sent through certified mail return receipt requested. You need to have a proof of this letter received by the company. If they continue to call after receiving your letter, you are in a better position to file a class action lawsuit against the company for violating the federal laws.
Be aware on the laws on recording in your state. You might like to pursue legal actions if they continue their violations.
