cedar, where is the data base of lawsuits? My suit was continued until 7/11, however I made a payment arrangement on this one because they are representing the original creditor.
However, the second one, which is CACH is a debt collection agency, who has not provided me anything valid for debt validation. They just sent me a discovery notice, I have one to mail back. I would like to read through the data base that you spoke of to get some pointers. thanks __________________

Hi Cherie,
DO NOT accept Mediation, it is biased towards the junk debt buyers like Midland! Here is Consumer Advocate Bud Hibb's page on Midland's scam: "http://www.budhibbs.com/collectorpages/midland_credit_management.htm" And here is an article about how unfair Arbitration is and what the Federal Government is planning to do about it: "http://www.justice.org/cps/rde/xchg/justice/hs.xsl/3043.htm" So, yes - they *are* working together - to screw you out of your hard-earned money. |

These guys are using all kinds of illegal scare tactics to get people who clients of FCNB to pay off bills that were actually paid in the past! I had a credit card with FCNB many moons ago. Since they went bankrupt, the automatic payments I was sending were returned to my bank, again many moons ago. About a year later, I received a settlement from Platnum Recovery and I began making monthly payments until the bill was paid off. Unfortunately, they never sent me any confirmation that the debt is paid off. I am now being sued by Midland, but I am ready for them. I asked by certified mail to be given proof that this was indeed my debt and they refused. In addition, they falsey stated that they sent me statement detailing the debt. What they sent me was an excel spreadsheet with "no payment received" in a column. How lame. I will let you know what happened to me in court. These guys are disgusting, but I strongly suggest that you do not ignore any summonses and respond to them in court.

We have a court date coming up this Tuesday. I'm nervous and don't know what to do! Our debt was not old and outdated, but all we wanted was proof that we owed them the debt then next thing you know we have a court date!! This debt was not even that old, it was with Home Depot and we just hadnt paid them in like 8 months. How could midland get it so fast and get us in court so fast??? My husband couldn't get off work so can I go in place of him and reschedule?

He should call the court and ask them about rescheduling.
