Midland Credit Management would not accept payment via mail

Hello all,

I was wondering if someone could direct me as to what my next step should be in my case.

I was sent a pre-legal notification letter from Midland Credit Management with a cutoff date to contact them. I called them to make payment arrangments and the lady I spoke with wasn't flexible and would only accept $250/mth. She wanted me to setup the payments via EFT or credit card. I explained that I would rather send them a certified check or money order each month and she told me that they do not accept payments via mail (her exact words). I'm unsure what to do now as I do not want to give them my banking information over the phone.

Any advice would be appreciated.

DO NOT give them any info over the phone. If they want their money badly enough they will take it the way you give it. Tell them you no longer have any bank accounts and offer to pay them with a pre paid debit card. Just put the amount of the payment on the card.

tell them your way or NO PAY, giving them your banking info or credit card info is not a good idea!

How old is the debt ? Does Midland have the right to collect it ? Has Midland sent any documents to validate the debt ?

How is this listed on your credit report ?

How did Midland come up with the balance ?

These are all questions I would ask and I WOULD NOT SEND ANY MONEY or give them info about checking accounts or other credit card/debit card accounts.

I also received a pre-legal letter from midland. I discovered these guys on my credit report before receiving the first contact letter. It seems they were on my report for a while. Actually, I received the pre-legal letter dated two days before the first letter giving me 30 days to dispute. I'll be sending them a DV letter soon but is there anything I should do about the pre-legal letter cuz' it states I have until a certain date to respond with a payment or it goes to an attorney.

If they are trying to force you into action before the 30 day validation period then that would be considered overshadowing which is a violation of the FDCPA, which you can file civil suit for $1,000 in statutory damages for.

Thanks JCEMT....... What exactly is a "pre-legal" letter? This letter demands money within one month or it "may" go to an attorney for legal action. The last line is "This is an attempt to collect a debt......." Is it even legal? It screams legal action if I don't put $250.00 down now and make payment arrangements before 6.18.08. Have you ever heard of such a letter?
