Midland Funding LLC – How do you deal with this collection agency?

I was ordered by the court to pay them because i didn't appear on the court date. Now I want to make arrangements but I don't know if I can. I'm afraid they will seize my tax return or my bank account. Can they ? or can I still make arrangements? I'm from Texas.

The court has ordered you to make the payments to the collection agency. You should contact the collection agency and request them to give you a payment plan so that it becomes easier for you to pay off the dues. If the collection agency gives you the payment plan, then your tax refunds will be safe.

you are wrong on one thing anna.the only creditors that can take tax refunds are the IRS,STUDENT LOANS,AND CHILD SUPPORT.please don't give incorrect info as again nobody but the three entities state can take someone's tax refund.they can however seize a bank account,but if a garnishment was ordered then that is up in the air as to if they will do both.

Hey Paul... Thanks a lot for correcting me... Actually, I knew that tax refunds can be taken by any of the creditors. Moreover, I have also seen people saying that their tax refunds have been taken by the bankruptcy trustee to pay off their creditors when they filed bankruptcy.

Great info! Is it the same for all U.S. states? I guess the OP wants to have a way out of it, but I'm not sure if she really can. Do you have anything in mind?

well actually TX,NC,AND PA are non-garnishment so while they can't garnish they can seize bank accounts in those states.i am hard pressed to find instances not tax related where they did both bank account seizure,and garnishment.

if you file Chapter 13 Bankruptcy, your tax returns will be taken by the trustee each year during the repayment period. There is no way out of it. It will be sent to you and then you have to endorse it over to the Trustee and its gone. It really sucks with that-thats how my family got our dental work and vision exams and glasses each year-tax return, so now no dental work for 4 more years and glasses I can no longer see worth a crap out of. But, its worth it to save my home, anything is worth saving my home

I believe Paul was referring to your refund being levied. Being required to turn it over to your Bankruptcy trustee is not the same.

Actually, in TX income from wages would be exempt so it is very difficult for them to levy your bank account.

Anyone wanting to show up april 4 in district court in sylacauga, al. A midland collector will be there trying to get something out of me. I was already in court and the judge let him have an extension to get more info and refile, and he has done that, now i have to go again! Acoording to the consumer lawyer i have talked to that prove they have is a zip file full of names and account numbers, and they have a bill of sale for it. NOT my account or proof or what i owe them, and no signature i owe them, so i am going ot have to fight them again, and hope that judge does not let him screw me with the 6,000 something he is going oafter. I dont owe them because i nevered borrowed money from them, any money that i did borrow at one time in my life was wrote off by the orig creditor they are stating that they are collecting on. All these third party by for pennies on the dime persons need to be dealt with by our congress, plz anyone want to start such actions to get them to stop taking vauleable time and resources from our courts, i am in, someome smarter than me start it, ok?
