Have a question...Morgan & Pottinger are representing Midland Funding.They say I owe them money-I already told them I paid it.They are investigating it-But they already have in place a bank garnishment and lien on property already in place until they investigate it. My attorney wants to charge me the same amount to take care of it and it is just as much as the debt the creditors say I owe. Wonder if they say I still owe it b/c the investigation proved me wrong...Is it too late to make arrangements to pay it so they won't go through any garnishments or liens? The fact that I paid it makes no difference.

Do you have your records that can prove your claims of previous payment?

Think about how you paid -- check, card -- there will be some kind of paper trail that can back you up.

Once you have located your records, you can write a stern letter (including copies of your records) to the lawyers informing them to pound sand.

Regardless, request validation to buy you time while you are locating your proof of payment.

I can't find any proof. But it wasn't taken off my credit report by the credit card company b/c I wrote an online dispute with the credit bureau. the credit bureau removed it.

Do they have a judgement against you? That's the only way they can place a lein or bank levy on you. Also, how long ago did you file the on-line dispute? On-line disputes can be mis-leading as the CRA's can suppress the tradeline but the data furnisher can re-report and it will show back up again.
