|
|
I have a debt with Capital One that was placed with NCO. I have been speaking with a rep named Anthony to settle this account. However, if I do not take their calls, since I only have a cell phone, they will call my mother. Apparently NCO did a skip trace and got her information. She is 87 years old and in bad health. They will call her every day until I call them back myself. She has told them to stop calling her. I have repeatedly told NCO to quit calling my Mom and only call me, since they have my phone #. If I don't take even one of their phone calls, they start calling her again. My family is getting angry with me for having my poor Mom harrassed by a debt collector. What do I do to enforce this request. They have verbally acknowledged that I have told them to stop calling her.

Put your demand in writing and mail it return receipt to NCO. If they continue to call the day after receipt of your letter, keep a log, and find a lawyer to sue for FDCPA violations (naca.net would be a good starting point to look for one).

How many times was your mother called?
There is a chance you could sue NCO for the multiple contacts.

Sorry...even though the debt is yours, it is not your fault that NCO continues to call her. If need be, refer your family to the FDCPA.
Also, you can file complaints with the BBB, your attorney general, the FTC, and (if in a separate state) NCO's attorney general. The more, the merrier!
Edit: In regards to my first post, specify that NCO is only permitted to communicate with you via mail.

Does anyone have a "good" mailing address for NCO. I need to send a cease & desist letter. Thanks

I sent a letter to them regarding a capital one account. They not only stopped calling, someone else wound up with the account.
