I had a previous post about NCO calling my 87 y/o Mom re:a Capital One acct. I had repayment arrangments w/them. I sent them a C&D letter for them to stop calling my mom and contact me only via the mail. I cited the federal law.
Even though bonafide repayment arrangements are set up, they continue to call me several times a day. What's worse & I am stunned to find out is they have continued to call my mom. They told her the ENTIRE story, so now she knows I owe $3700.00. She kept dates, names and #s of the calls, just because she is so concerned about what is going on. I had a nice working relationship w/ Anthony Migliacco, but somehow got shifted to a Mr. McCoy who is very antagonistic. He wants to "conversate" with me re: my account, even though payment arrangments are set.
So... I know they are in clear violation of the law and I need to get an atty. But, what do I have to do to get them to stop calling my Mom? Since they are in blatant violation of the law, do I need to uphold my in full payment arrangements? This has created an embarassing situation, plus I don't need dear Mom worrying about me. Any advice is appreciated.

I love it when low life scum tries to make up words to sound important. Tell him you won't "Converse" with him till he learns to speak proper english and stops making up words that don't exist.

OH by the way, ig your mom really is keeping such good notes, obtain them then file suit against them for $1000 per violation in federal court for violation of the fdcpa. You only need 4 violations to pay off your debt. IF there is more, give the money to a chartiy in your area that needs the help. After all you dont want to use their ill gotten money for personal gain.

LCW is right. File suit against them in your jurisdiction. This should make them take notice of the law for a while.

I'm currently in the first stages of sueing Capital One. I can tell you they are complete jerks. They blatantly ignore the law.

I got my lawyer through naca.com. You can do a
search to find one in your area/state. I don't know
about all of them, but my lawyer doesn't get paid unless we win suit.

I am not sure, but since you are in a repayment plan, and they continue to call you and your mother, wouldn't that negate the contract to repay?

Capital One are a pain to deal with & once lawsuit gets to the Discovery phase they will go away after your attorney buries them in paper.
