One of my credit card accounts went into collections in January 2012. I received a summons/complaint. I promptly contacted the debt collector and made arrangements to pay back the debt in installments. Thus far, I have made the payments and have copies of the cancelled checks to prove it. Today, however, I have received a notice for a judgment lien from the debt collector. Is this possible/legal if I have made all of the payments thus far? Please help! I am VERY scared!

Once you are in collections or the debt is charged off, they have every right to sue you. Answer the summons that you are making payments. However, they will get their judgment...what you need to ask for a conditional judgment which allows you to continue making payments without them garnishing wages or levying your bank account. It is important that you show up in court.

PDL's are ILLEGAL in the following states...
AR, AZ, CT, GA, ME, MD, MA, NJ, NY, NC, PA, VT AND DC
OH AND NH have very restrictive low cost interest rate laws.
SOL for all states

What chances do I have of getting this conditional judgment?
