I understand we are in debt. We had a debt we have been paying on, one of the last actually but with everything that has happened we defaulted on a bit under 150 bucks...at this point we can barely afford our rent and utilities, we have been treading shark infested waters for a few months now, we had our car repoed a while back (volentary, not that over matters how it got repoed), we got evicted, our nice cleaned credit got tanked.

Well, this company has been hounding us left and right. It got to the point where I was calling them on Fridays and Wensdays just to keep them apprised of the fact we can't pay. I explained it all to the supervisor, hell we had to tell our youngest that there is no Santa because budget is so tight we can't afford presents! We promised the kids that we would make up for it at tax return...plus our situation is now clearing up, just these last few months have been bad.....I even told the lady that I understand it is not acceptable, but we do intend to pay it in full with tax return. They still call, they even call the references even though they know where we are.

Well, apparently they really know where we are because good old Beverly, the supervisor, showed up knocking at my door, I kid you not!!!!!!!!

She immediately went to the attack and I explained it again, for the hundreth time...you can't get blood from a stone. She then says since it is my husbands account, she wants to speak to him. I told her he works, overtime I might add, helping us get out of this huge financial mess! She says she wants him in the office, by this friday to 'discuss it'. Even then I was all, "Well ok....we have to scrounge the bus money (how bad is that?????) you guys are a bit aways.." she then interrupts me with, "We are just over on Paramount." I just look at her and she in a very condecending voice points to the truck sitting in our driveway....OMG that truck belongs to a friend! Didn't she even listen when I said the car was repoed???????

She left. Then I woke up fully and got hopping, spitting mad!!! I called and blasted that company, told them I had it, I was done. Call all you want, I am no longer accepting any calls, come to the door again and I will slam it in your face at least, sick my dog on you at worse (and trust me..she is a little psycho cuz she has a litter of pups). I adsvise you not to call the references anymore because I have told them the next call they get to record the call and tell you to not call anymore or they will file harassment charges.

Ok..so the lady starts to talk about working with us and maybe lower the monthly payment...

OMG!!!!! at that point I yelled, "thats freaking it! I'm done with you. I will pay you in feburary with tax return and you should be lucky I am still going to, because at this point unless money rains down from the sky, you can take this debt, throw it on my credit report and kiss my A$$."

A debt collector showed up at your door? That is messed up!!!!!!

I probably said it before on here but when I had surgery in February and was diagnosed with cancer I had no money coming in, only like $339 a month from welfare. The bill collectors called my house I told them I have no income, I have no assets,I just had surgery and I have cancer. The only thing the guy said was "well sir, your account is seriously past due and can be a negative impact on your credit" I said " who gives a crap, I have cancer" He tells me " can you borrow the money from a friend or relative" I told him to go to hell, stop calling and I will pay when I get the money.

They continued to call every day 4 times a day till I had the money to pay. These people do not understand and do not care about the ill, they only care about themselves.

Well hell, seems like when a person is down it's most likely the time you will get kicked and kicked again. Sorry for your unfortunate situation, just hang in there and remember, it's only temporary.

You seriously need to get a lawyer to take your case. There are so many fdcpa violations it is absurd. What is the name of the company and what state do you live in.

Dang..it isn't a CA..it is the original creditor. It is some hole in the wall loan place, the terms were good, no hiking of the interest or anything, nice loan actually..but the people are horrible. When our first payment date came and gone, they called and said, "We will be by your house tomorrow to pick up the payment". I thought they were bluffing! I told her that well, you can come, but I will tell you the same thing at the door as I am on the phone now, we don't have the money.

It was a simple case of getting to complacent I guess. Like the guest post above, I started to get sick, I sometimes take to my bed for days at a time. I finally went to the DR and found out I have some cancerous growths on my spleen and liver....is what is making me sick and in pain. I missed alot of work and boom..things went downhill from thier.

I wish the company was a CA, I would sue them so fast thier head would spin! But this is a OC...a very aggressive one at that. We are in Texas, so they can't garnish us and we own nothing, so I am not really worried about being sued..let them, it will just be something we work on fixing as soon as we are fully adjusted to our new level of living (since I can't seem to work now).

What I mean by first payment date, I mean the first one we defaulted on....we had been paying it down just fine for a while...until we no longer could.

OMG! Aren't there any laws in TX to protect a debtor from the OC's?

At the very least, I would think them showing up at your door is some sort of violation? I've never heard of any OC's or CA's actually showing up at your door. That's a first for me.

I would tell them you're going to sick the law of them the next time they show up at your door. Seems like some sort of trespassing charge could be brought against them, especially when you've already told them not to come.

Yeah that is pretty much what I am gonna do next. I told them they are not welcome on my property. I will call the police the next time they come to the door.

Let some CA or OC come to my door trying to collect. I've got a mean Chihuahua, that thinks she's a Doberman, that's not afraid to try taking on a 300 lb Great Dane. I'm sure some chick from a CA would be no problem for her to handle.

Funny thing is, when she went after the Great Dane, making a ton of racket in the process, the Great Dane actually seemed intimidated. My dog wasn't even as bis as one of her paws!

She could have flattened her in one step.

I have a chihuahua too!! She thinks she is a rottweiler She has her first litter of puppies and so she even thinks she hears a stranger so goes nuts.

I am so sorry to hear about your financial and health problems. You have enough to worry about, with the health alone. Take care of yourself, and pay them when you get your returns.

Check with your local churches or helping agencies and see if they can help with getting the kids something for Christmas. The schools here even help, if you tell them of the circumstances.

Get rest, take care of yourself, you can only do what you can do. You will have them paid off with your taxes, then you will be rid of the idiots!!..karen

I don't go to the church for help, even though they have offered, makes me feel like too much of a hypocrite since I am pagan. I had a sit down with the kids and explained the situation (we often have talks) about my health and the financial situation...my kids are wonderful at times..I woke up the next morning after we had the talk and found the whole house was cleaned..the 11 year old actually got the 9 and 7 year-olds delegated into chores. They wanted mom to have a 'easy day and play video games' exact words:P

I was just trying to work with the OC...I actually did feel bad since they did not buy the debt for pennies on the dollar and were in fact the ones who gave us the loan....but coming to my house on top of making me call twice a week was just too much...no one, no matter what, should have to put up with that.

I would get a restraining order against the co. so that next time they show up at the door you can have them all arrested.

UPDATE:

I was true to my word..I refused to answer the phone or call them back. Well, good old Beverly called and left a voice mail. In a very nasty and condescending tone she said, "You need to pick up the phone and cal me, your account is seriously past due. You need to start answering your phone! If I don't hear from you, it will require another home visit."

Oh HELL no. I called the police.

The dispatcher was flabbergasted..she has never heard of a company doing this. She said it is in fact trespassing. If the lady comes to my door again, I call the police without her knowing, and if she is still there when they roll up, she will get popped for trespassing.

I am going to call her and give her fair warning...though it is so tempting to just let her come and get popped. But..she was o condescending I can't resist calling her and cheerfully telling her that if she comes to my house she will be guilty of trespassing and the cops will deal with her. Let's see what the pompous witch has to say about hat. I will let you guys know what she says.

She is SO lucky I pay my bills.....we should be getting tax return in the next month or two and we will pay it...but they have harassed me so fully I admit o being severely tempted to tel them to take a hike...I even warned them last time I wouldn't pay if they continued the harassment.
