I am in deep need of help dealing with Mann Bracken. I recently received a letter from their office stating that my account had been referred to them for coolection in the amount of $7300.00. After receiving that letter I responded to the letter to the address shown that I was somewhat confused to this as I have always made monthly payments all months since having the account on time except for a couple of months and doubted this to be correct. Of course I received no Acknowledgement from my letter back. Well about 50 days later I now receive a letter for a summons to appear in court from Mann Bracken for the same issue with the balance now around $6300.00 because as mentioned I pay Chase monthly and did not think there was an issue?? The same day I received the summons I try to call Chase and no one said they had any information to give to me and to contact Mann Bracken. Being very concerned now I pulled my credit report and see that only Chase owns this debt, but oddly enough Mann Bracken checked my credit History back in May. Still being confused I wonder why Chase has allowed this action to take place and start to do some research and find that my account was over the limit for the last due to a charge that was allowed to be approved for over $1300.00 over the limit. Like an idiot I did not realize this and have just paid my normal payment to Chase over the last 3.5 months, but noticed this about a month ago and have brought the account back to under the limit and according to their website I do not owe a payment until the next billing cyle and the account is current. Worst part is that I have not used this card in over 7 months so I doubt the transaction that was allowed to be processed to take it over the limit. SO what do I do in this situation?? The debt is mine and have no issue paying it. Do I pay Mann Bracken or continue to pay Chase just as I have for all months on time as I have always?? If I can pay Chase how do I get to talk to someone that can actually effect anything?? HELP???

You MUST send a debt validation letter to Mann Bracken. They need to provide you with the following:
How they arrived at what you owe.
Proof that they a legally allowed to collect the debt either as an owner that purchased it or as contracted by the original creditor.
Any payments you have made on the debt and when.
Proof that they are licensed to collect in your state.
A collection agency can't order you to appear in court. Only the court can and only if the original creditor sues you. Or the CA if they legally own the debt

Can I still pay to Chase? My account is active and they process all my payments?

If they are procesing your payments you can. But get that letter out immediately! Also tell them in that letter that you will only deal with the original lender and they are still taking payment from you. And make sure it is certified return recipt. Documentation is everything! Did you read the link in my last post?

If the account is not sold off you can still make payments.

When credit cards are sent into collections it is uauly for one or teo reasons. One you haven't made a payment for more than 90 days or two you have had a past due balance for more than 90 days. When these things happen for whatever reason and are forwarded to collections the balance is due in full.

You will continue to recieve statements from your credit card creditor because by law they must inform you when intrest or any other fee's have happened. This will happen until the account is paid or charged off.

The quickest and easiest way to find out if you are in good standing with your creditor is to try and use the card.
