|
|
Several weeks ago my adult daughter used my home phone to contact some of her debtors in an effort to reach a settlement of outstanding debts. She lives out of town and I seldom see her, she happened to be visiting and we encouraged her to try and work something out with the companies she owed money. Well they didn't call her back in a timely matter, she returned to her home and now every morning I get an automated phone call from Palisades leaving a message for her. She ultimately made the decision to file for bankruptcy protection and has retained a professional lawyer. What is my best tactic to get these leeches off my back and my phone.
I have no dog in this fight and I don't appreciate the harassment.

I would just tell them that she doesn't live there and that she has filed for bankruptcy and they are violating the automatic stay that goes into effect the minute the paperwork hits the federal courthouse.
Hopefully that will scare them off. If not if you have her attorney's name and number I would refer all calls to that office, let them handle this.

Your daughter needs to call Palisades and tell them she is filing for bankruptcy, and give them her attorney's information. At that point, they should stop calling.

I know I've talked about my ex a few times, on here. But...here's a 'doozy', if anyone is interested. Every once in a while, especially with outstanding utilty bills, my ex gives them MY number and tells them that I will take care of them. So...when they call, I tell them "they have the wrong number." Ain't that crappy?! My ex has done that with his parents, too. I mean given utility companies his parents number, as well. Talk about irresponsible!!

Here's a trick to get all automated calls to stop. You know that 3-tone sound you get when you reach a disconnected number? The automated dialers listen for that first tone. If they get it, the delete your name from their database.
Go to the interet and search for that sound. Edit the file so you only hear that one sound. When you record your voicemail greeting, start with that first tone. No one will notice except the auto dialers!
It's a bit of a hassle, but it has worked for me!

why go to all that trouble when you can do this the legal way and simply mail them a letter?
Interesting idea, but I doubt a 3-tone sound is going to help you if you ever get a chance to take a collector to court over FDCPA violations. However a letter, on the other hand, sent via certified mail, return receipt requested so they have to sign for it and you have proof it was sent and received....

Great point, SueBeeHoney70! No need for Frustrated to go to such extreme measures with the OGM on her answering machine, when all she should really have to do is notify them that they need to stop calling.
Of course, it really is stupid that she should even have to do that, since her daughter doesn't even live with here and there should really be no reason she should be receiving the calls. But if she does send the letter CMRRR, then she might make a little money in the end, if the calls don't stop, by suing for FDCPA violations.
It would be nice if she could just verbally tell them that, and they would abide by it; however, I'd be willing to be there's no way in Hades it would happen that way. So written notice will probably be the only way to go.

Yeah, you use the 3-tone thing to stop automated computer calls from TELEMARKETERS. If a live telemarketer, or bill collector, they will know it's not disconnected. I tried that trick and it only works some of the time. I use the Do Not call List, and for those exempt, (Like charities and previous business contacts) I use call block. The rest are screened through my answering machine and caller ID.
Send the letter.
