I have. My daughter had bought a cell phone last year, when she graduated Basic Training in South Carolina. I believe hundreds of kids were doing the same thing. Anyway, long story short, she wound up coming home from the Army in a few months, and spent several months unemployed. She was unable to fulfill the contract, and had to cancel it. Well, she paid the past due, and the cancellation fee, and thought that was the end of it. But a few months later, she gets one letter from a Carolina Cellular, informing her she owed them $300. She had never heard of them, so threw it away, as she had paid Cingular off. Well, in April, she gets a phone call from a Mr. Murphy, from PRC, telling her that she owed them $300, because it was a dual contract. She was never told of a dual contract, and I have never heard of such. I spoke with AT&T today, and they told me that this was not standard procedure. Neither business is with the BBB, either. I believe that it is a scam.

If Carolina Cellular is the place that she bought the phone from the "dual contract" is probably the secondary agreement that states if the account is canceled within a certain time frame (generally 181 days with Cingular/AT&T)the store will charge the customer a fee to cover the cost of the phone since Cingular will have taken back the commission that covered the real cost of the phone. She should have signed an agreement that states this.
So definitely have PRC validate the bill.

I am in the cellular industry and these agreements are common for the non-corporate (independent, contracted representatives) stores. And as for AT&T saying this is not a standard procedure is wrong. The customer service people don't have the faintest idea how non-corporate stores operate.

She bought the phone from a Cingular store in the PX on base. She paid over $250 for that phone, and lost it. We got another phone, and had the service restored. It was about 4 months, I think that she had the service. My point is this, she was never told there was a 'second contract' I can find no information on the Carolina Cellular with a valid phone number. Just a personal voice mail. I am going to check it out with the Better Business Bureau, and the Credit Bureau.

Sample Debt Validation letter. Do not pay a collection agency any money without first sending this letter. If you have any questions, please contact Anthony.

Re: Acct# 00000000

To whom it may concern:

This letter is being sent to you in response to a notice sent to me on March 8th, 2050. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following:

1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe
4. Provide a verification or copy of any judgment if applicable
5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:

1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with third parties, it will be considered harassment and I will have no choice but to file suit.

It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records; any information obtained shall be used for that purpose.

Thank you,

Hi Rilla

Debt Validation letter is your best defense against collection agencies that try to force people to pay for the debts that they don’t owe. The FDCPA allows you to dispute a debt in writing with the CA within 30-days from their first contact. They cannot play stupid games with you about not verifying the debt. The Federal law requires the debt collector to send you the proof of the debt or a copy of the judgment. If the CA is unable to do so then they must stop making all the efforts to collect on the debt.

The CA after receiving your request must give you evidences in writing that substantiate that you owe the debt and it was never paid in full. But most importantly they must prove that the debt is assigned to them by the OC. Finally, the CA must give you the details of the calculation of the amount they are requesting from you. Because most of the CAs buy the debts in pennies and charge in dollars from the consumers.

Until and unless the CA verifies the debt do not pay them. And remember to send the DV letter via certified mail with a RRR.

Take care

That is the behavior of unsavory companies. They act vague and only will speak on their terms. Those behaviors are usually indicative of illegal companies.

Guest: May I inquire who it is exactly that you are referring to? If you are addressing PRC with your comment, you are at the wrong site. If you are simply relieving stress caused by PRC, then we here welcome you to join this site that seeks to inform consumers, like you and I. We are regular, hard working people, who have found one another after dealing with less than savory collectors or creditors. Some members are here to seek information which may improve their current situation, and if you seek information that may improve your financial standing, than we welcome you.

Most of these agencies do business by intimidating consumers. Fear is their No. 1 weapon. They will pester innocent people with harassing calls. They threaten them with civil suit, garnishment of wages, criminal prosecution, and seizure of property, job loss and even imprisonment. This is nothing but one of their sleazy tactics to squeeze some money out of consumers. In my opinion the best way to deal with such people is to be aware of one's rights.
