So, I get a call on my cell from 1-222-222-2222...got back and listen to the voice mail and its NCO!
They have been calling me from various phone numbers here and there, and no written notice from them as required by the fdcpa within 5-days of the first call.
I am sending them a DV letter tomorrow, but did I also read someplace on here that per FDCPA CA's must use their real phone numbers when calling? Someone let me know so I can include that in my letter too.
Also, the automated message didnt give my name or anything, but said that they were "NCO and they needed to let me know that they are a debt collector".

When they call me (usually a 'private' number) and I don't answer the phone, they leave a recorded message..........'dear so and so, this is concerning a business matter.".....Good grief.

I seem to be getting the calls that say if you are So and So press 1 if not hang up..well when one is not at home how can you press the number..the after silence from the machine..they go on to say that by doing such and such you are so and so and that this is a call to collect a debt and on and on..i get so tired of those calls i could just up chuck..

Incredible....I get a call at 8:01am from the 1-222-222-2222, left a message and then they call again 800-448-9570 and left ANOTHER message.
Checked USPS and looks like they havent gotten my DV letter yet.
fdcpa says one message, per ph# per day right?

actually, I dont believe the fdcpa places a number on how many calls or messages they can leave you. The idea as stted in the law is that if the calls are such that the intent of them is to harass or annoy, then they are illegal. And I think that in any reasonable line of thought, calling twice, one right after the other, is not reasonable.

Volley, I thought that if they used a fake number to call you, it was illegal, but am not really sure.
LVNV is great about this-they do 000-000-0000, and make about 4-5 calls a day, all with different numbers showing on caller id. Alot of times they call at one minute before they are supposed to, or one minute before they are suppossed to stop.
I just keep track of their number that is showing, the date and a name(it's fake, i know) and let them know that they have called xx number of times and still haven't validated.
Every time I send a DV letter follow up, I like to point out the violations they have made

Oh, BTW-several years ago, before I found the forums, I dealt with NCO and got a really nice man, I set up the paymentw I could afford, paid it off, etc. Then years later had to deal with them-another story, so guess they get rid of the nice ones!

I wonder why they would not include a number on caller ID that you could use to call them back. I'm sure it would facilitate establishment of relations with their contacts.

Using a real nmber, or the same one each time, would make it easier for folks who don't want to talk to them to skip the call. Same with using their real name. I know, it's stupid. But that's how their twisted, little minds work sometimes.

Actually, the fdcpa sort of puts a limit on the number of calls by saying:

1. Multiple phone calls. "Continuously" means making a series of telephone calls, one right after the other. "Repeatedly" means calling with excessive frequency under the circumstances. |

volley did you send simple certified (green card) or pay extra for guaranteed signed receipt? I know you know what you are doing here from your posts..but don't expect them to accept letter unless you send guaranteed certified with signature ..approx $15 cost to you ..(cost last time I sent one requesting validation to ca who refused normal certified letters about two years ago)..good luck many companies will not acknowledge debt validation letter on simple certified (green card)...items..they simply refuse to accept and then they are returned a month or two later..just what they have planned.....part of their deception tactics and time frame of disputing

You can document the refusal of the letter along with the returned letter to show that you tried to request validation but it was refused.
I would imagine it wouldn't look to good on their part, especially when you make copies of the letter, envelope and notice of refusal and send them as an attachment with complaints to the Attorney General's office and the Federal Trade Commission.

What NCO needs is not us paying them but for them to pay back all the people they wronged by reporting incorrectly on all of their trade lines. Even after getting hit for 1.5 Million in fines s/p being sued by the FTC, they still continue to do so.
