Sub: #1 Over paid Collection account refusing refund

I over paid collection account, but they refuse to refund over payment.... I had purchasing account with a company which I bought products through to get volume discounts. I had some dispute and It went into collections. We paid full amount that collection agency agreed upon on the phone. Payment was sent to original creditor and few month later collection agency called again demanded more money. We did not have any thing in writing on original agreement ( stupid and naive!!), so we paid their additional demand in full to original creditor.

When I accidentally login to see my statement on purchasing account(original creditor), it states credit of $1300 on my account from over payment and some credit from vendor issued defective return merchandise credits. This purchasing account holding company(OC) refuse to refund credit to us. I have copies of current month statement from their web site indicating credit. They are saying account has been closed and ask us to talk to collection agency. I don't want to talk to low life blood suckers (CA). What can I do to get my money back from them?

Have you tried filing a complaint with the BBB?

You shouldnt have to go thru the CA when the OC is holding the credit, regardless of the account being closed. I would suggest writing them a demand for refund letter, giving them a specific timeline to pay up. They are holding your funds, not the CA.

Unfortunately because this is a business account, the fdcpa would not apply.

The if creditor still owns the debt then it is the low life blood sucking creditor you should be talking to about a refund not the collection agency who handled the account as any money you paid the agency went directly to the blood sucking low life creditor.

Ouch, raw nerve FYI?

I'm not sure I understand why the OC will not issue the $1300 overpayment, even though the account is closed? I'm presuming they would be required to, since it is in fact an overpayment and not really their money. Have you talked to the OC on the phone? Was it with a "front line" customer service rep? If that is all you have talked to so far, you might need to start asking for a supervisor. Heck, if you were feeling really adventurous, you could start calling executives at their corporate offices. I would make plenty of noise until I got that refund!

I agree - you need to let them know you have overpaid and that you want your money back. If they don't give you a refund then you really need to take it to the next step. Possibly filing a complaint with the BBB.

I had a rough week and I wasn't my normal self when I posted that and I apologize.

Filing a complaint with the BBB is a good start. You might also want to shoot a letter off to their complaint department as well as the director over customer service. You may also want to seek attorney advice.

I can not apologize mom and can not understand why those kind of comments can be made from a mod..calling people quote "low life blood sucking creditors"
I believe that is uncalled for and I am out of here this is not right!

I think that maybe socks mistook "creditors" for "debtors". It appears that at times that socks has a problem with FYI.

Socks, if you want to call me out on something make sure it's real and logical. Attacking people on this site is not welcome. If you have a problem with me I suggest you send me a PM about it because from here on out I am simply going to ignore any post you make, like it wasn't even there.
