What to do if you are harassed by a Collection Agency (CA)?

The Fair Debt Collection Practices Act (FDCPA) has laid rules to protect the rights of debtors. Here are a few ways by which you can be protected from harassing collectors like RAB:

  • Stop 3rd party calls: If a debt collector is calling your family member, friends, neighbors, employers and employees for your debts, when they have your number, it is against the FDCPA rules. The only time CAs can call these people is when they cannot locate you. If they already have your location information, then they can no longer call any third party.
  • Stop calling letter: If you want a debt collector to stop making collection calls at your home, you may send him a 'stop calling letter'. To stop them from calling at work, you may either do it verbally or simply send them a letter asking them not to call. There is a restriction to the number of times a Collection Agency (CA) can call you in a day. Be aware of these rules and protect yourself. You may find sample letters available, which, you may use to send to the collection agencies if you want them to stop calling you.
  • Record phone conversation: This is an effective way to stop collectors from making harassing calls. You need to inform the person on the other side that you will be recording this telephone conversation as evidence. This evidence will then be used to file a formal complaint with the State Attorney General and the Federal Trade Commission (FTC). Remember that you should inform the caller before you begin taping the call.

The FDCPA protects your rights as a debtor and you must be aware of the laws in order to tackle debt collection agencies. Unless you are aware of your rights, you cannot get respite from harassing creditors.

  • Regional Adjustment Bureau/RAB
RAB Inc Regional Adjustment Bureau company is calling me non-stop at home, at work and now on my cell!! I called them and told them that I DID NOT want them to call my cell phone, as I am charged for those calls. Well the little B***H on the phone told me "oh yes we can call your cell phone and you need to pay your bill", I told her she was a joke and hung up. I can't take this anymore, I've told them to stop calling my place of employment as well, but it just does not stop. These people are SO rude and demanding. What can I do????

I would suggest sending Regional Adjustment Bureau Inc. a letter instructing them to not call you at work or on your cell phone. Send it certified mail, return receipt requested.

My neighbor was called by RAB inc, and asked several questions about my son and his credit. Are they allowed to call your neighbors and ask about your financial history? When his credit situation has nothing to do with me.

I pay all of my bill yet I am getting phone call after phone call about a neighbor I don't even know! why should I have to deal with this! All I did was buy a house near to someone who obviously doesn't pay bills!

Maybe you should feel grateful that you don't have financial problems like so many of us do. And perhaps you should have compassion for your neighbor. I understand that phone calls of this nature can be frustrating, especially when they have nothing to do with anyone in your household. Can you imagine how those of us who know they owe the money but can't afford it feel????

These phone calls can be stopped if you submit a cease and desist letter. Send it via mail, certified return receipt. Verbal requests do no good. However, you may still call teh Regional Adjustment Bureau phone numbers and speak with the representatives asking them not to call you further or maybe you could inform them that you have sent them a letter. Not sending it certified return receipt usually does no good either. It will cost you about $5.00 to mail it this way, but you stop the calls.

my household pays our bills, we are lucky to be able to do that. I don't appreciate getting a call at 8:30 on Saturday morning asking if I know my neighbor next door (didn't even recognize the name)!! I don't want to be disturbed because a nasty bill collector can't do his/her job!! makes me sick.. how about somebody call my neighbors and tell them to thank me for paying my bills? so disgusting.

I am self-employed and there is a bill collector calling me on my business line. I have asked him to not call my business line because it is for business purposes only, but he says he can call any F*****N number he choses. Does he have the right to call me on this line if he has my other contact number?

More details please. What state do you live in? Is this a personal or business debt? If personal, is it still w/in the SOL for your state? You can send them a cease comm letter, but if it is still w/in SOL, it could get you sued. Did he actually use the "F" word? That would be a violation of the fdcpa and actionable if you can get it on tape.

The best way to write to any of these places is to write a basic letter. At the bottom of the page be sure to include the name of everyone you mailed a copy of this letter to. Send it Certified mail, return receipt requested. Make sure someone at each office has to sign for your letter. Then later no one can say they did not get a copy. File complaints with as many places as possible at the same time. Make sure in this letter that you request that this company stop calling you on the numbers that could cost you your job and tell them to stop contacting your neighbors, relatives and friends.

The only way to break a place like this is fight them as hard as you possibly can. File as many complaints at the same time as you possibly can. Eventually they will be stopped.
