In an earlier thread this afternoon, I commented on the fact that three yrs. ago after undergoing a bankruptcy that the PDLs that I had were discharged. They all were, but in looking up my recent credit reports, bankruptcy for one of the PDLs is not even mentioned. The account was placed with Simms Associates, a collection agency about a month... three years ago before bankruptcy was filed. Will go to attorney's office to get a list of all the creditors to make doubly sure that this PDL co. was included. I am certain they were because their name was listed amid several other creditors. I won't call these people either. The minute the consumer gets on the phone with these people, they act like starving black widow spiders Evil or Very Mad that haven't eaten for weeks and begin the process of draining the life out of you demanding payment on a debt that you either may or may not owe. I will have my attorney handle these turkeys to get the info on the bankruptcy straight. Has anyone ever pondered the fact that creditor, rhymes with predator? Think about it..

good luck with all of this - i really agree with you 100%. It seems the moment I started to really tackle my debt, they all came out of the woodwork and are coming after me..

CA's aren't worth talking to if they can't even LISTEN to you. When you try to explain what's going on with you, they could care less. It's like talking to a brick wall, isn't it?! Why answer the phone, if no one on the other line will listen?

Collecting on bankrupt debt is a serious violation of the permanent injunction of the bankruptcy. Have your attorney file a motion of contempt for bankruptcy code violations.

You know I really hate to lump all creditors/CA's into the "predator" category; however, my own personal experience would seem to add weight to this argument. I remember returning a CA's call, sometime last year, and attempting to explain to the woman in a civilized tone what my health and employment situation was and it was as if I had flipped some sort of switch on her. She went from "Zero to Bee-Yotch" in about 2 seconds. She started yelling, talking over me, telling me she didn't want to hear my excuses. When I told her she was seriously violating the FDCPA right now, and that I'm sure her company must be recording the call and all I had to do was get an attorney to subpoena the recording and I would win a lawsuit for violating the FDCPA. To which she advised she didn't "care nothin' about the FDCPA." It went on like that for another minute or so, and I just had to finally hang up on her.

Fortunately, for her, she didn't call back.

And yes, if that PDL was included on the bankruptcy, and you need to make sure it was, then the CA that is collecting on it (and yes listing it on your CR is considered collections) then I would definitely follow up on that.

And by follow up, I mean sue.

you know, when I filed bankruptcy I had a pdl call me up, screaming, telling me to grow up, etc. My attorney wanted to meet with me due to their illegal collections but i had enough at the time (not to mention not enough gas to go to the attorney) and told him to forget it.
Since than, I wish so badly I went..

i agree with you beals,i tried to file bankruptcy this last year.i realized that most of these CA's are illegal and immoral,why should i ruin my credit when the law can work for me.just to be clear i did give a BK attorney two payments toward that,but it was only 300.00,but still a CA should be willing to work with you.

well, the thing about bankruptcy is that it didn't work - it erased the debt i had but obviously i'm here so it didn't work until i was serious about making lifestyle changes (which I am now)
