What do I do?? I did not give them authorization to do this!! This is a new account! How did they get the information for my account???

I called the bank and they said that it would take 7-10 days to clear this up. Meanwhile I have things outstanding! My account is overdrawn because of this!
The bank gave me a number for the ACH department of someplace called Columbian Bank and Trust. The number is no longer in service! I am freaking out!!!

Why did they advise it would take 7-10 days to recover your funds when this was an unauthorized debit. Shouldn't this be treated as fraud and isn't it normally faster to recover your funds in that situation? I'm honestly not familiar with how this works I'm sure someone with more information will be along soon. I had this happen but my bank actually returned the ach transaction and didn't let it go through so the only thing I had to recover was the overdraft fee which they just required me to go in and sign something and have it notorized saying that this debit was not authurized and they even credited the overdraft fee's back to the account to get everything taken care of.
I hope you can get this worked out it's just not right you should have to wait 7-10 days to recover your funds.

I agree Johnita...especially since this debit was unauthorized! I was NEVER notified that any money would be taken out! Imagine my surprise when I check my balance this morning and see a debit for $400!!! The company that they are collecting for never had my new account number! That in itself should be illegal!

I would also suggest making Smith Haynes and Watson pay your overdraft fees. You should also explore the option of seeking remedy by civil action.

Just an update..I went to my bank yesterday and filled out the proper paperwork. My $400.00 was back in my account this morning! Plus the waived all my overdraft fees! I need to go back into the branch and fill something else out that will not allow SMith, Haynes and Watson or any of its affiliates take money out of my account! I am so relieved!

I believe they are a collection agency. They were collecting on behalf of a payday loan that I had way overpaid. When i called them to explain the situation, the guy yelled at me and then hung up on me!!!

they work with genova roth.. if you look at the payday forum, you will see a way to stop the ach processor - blocking them might not help as they most likely will try to go into your account under different names..

That's just crazy! Fill out a dispute with the bank and tell them you did NOT authorize this transaction! It may take a few days, but my best guess is, the bank will return that money to you, especially if it was an unauthorized transaction. You really need to place a hard debit block on that account, or CLOSE it out completely and open a new one, because this company will NOT stop debiting your account as long as they have your account information! They will change their name, and debit it under another name unless you take control of this account NOW! Please start a new thread in the Payday loan section of this forum and you will receive some VERY good advice on how to deal with this company.

Also since this was unauthorized, you may be able to get the bank to reverse the OD charges, if any apply due to this. Do go in and talk to the bank and see what they have to say in person. If you do not get satisfactory answers from one person, ask to speak to their superviser, and if still no satisfactory answer, keep moving up the chain of command
