Hi,


I received a summons about 2-3 weeks ago. I had an account with discover card. I lost my job 3 yrs ago because of union activity. On the summoms I owe $6'677.07. I didn't know what to do so I responsed to the summoms today at court, I don't won't my check to be garnished. I can't afford to pay that. What can I do? The attorney is Buckles & Buckles PLC. I called them to try and make a settlement from $2000-$4000. The lowest they would go is $6200. I told them that was to high.(My grievance is still active. It was just reinstated last month at an appeal.) I write I did breach of contract because of lost of my job due to union activity. Just could not pay amount owed. Discover would not lower the amount of payments. Therefore, I could not pay. I still have 2 other outstanding visa bills $6,000 and $8,000. At the moment I,m only getting calls.

I was using debt relief of America. The way they explained it to me was they would handle all the harnessment. Don't worry, but than when I got the summons. Yes, they can sue you and tell us how it turns out. Well with the money I've been paying you can't you make a settle offer or something. They said no. I must first pay $1320 administrative fee and 7% of $18.867 first and save more in my account first. I really don't know what to do now.

I am so sorry to hear about your situation. Don't stress too much. You had your appearance in the court today?? What did the judge say?

Hi guest! I'm sorry that you are going through this difficult time although I'm not sure what can be done at this point. Once you get sued and its in the courts, your chances of negotiating are pretty much over. Its up to what the judge says that you have to do now. Usually if you will declare financial hardship (and you really are having hardship), the judge will look over your finances to see what you can afford to pay and take that into consideration. I have been sued before. In my situation, I got the summons, had to call the lawyer and they asked me what I could pay and if I could pay 'so and so' amount. I said yes. They took it to court, told the judge that we had already agreed on a monthly payment and the judge went along with it. I kinda got shafted on that deal but next month is my last payment on it and its a done deal. Except I will have it on my credit report for many more years to come. would someone else like to jump in here, in case I am missing something??? guest, let us know how it goes in court and what the outcome of it is. shirley
