I just received a summons from Forster & Garbus delivered to my doorstep. They tell me I have 20 days to respond. At this point, can I respond with an offer to settle or is it too late?? How am I suppose to respond anyway? No court date was given. They are collecting for Macy's Visa BTW.:(

...but they have chosen to sue me instead. They're obviously not interested in settling until push comes to shove I guess. They've also NOT provided me with any court date, as it says "Notice of Commencement of Action Subject to Mandatory Electronic Filing". Can I make another offer to settle and ask for a specific court date in writing at the same time?

The reference link mentions a copy of an "answer and appearance" with which to respond to the attorney. What is this and where do I get a copy? Can someone please translate?

You need to look up the Rules for Civil Procedure for you state for information on how to answer the summons. Look it up on your county court house website.....that is also where you where you will find your court date. And call the attorney and try to settle for it hits court.,...the judge will ask if attempts have been made to resolve the debt.

This is NY state. I tried to locate my judgement so I can get a court date, but didn't have much success on their website. It's not very easy to navigate through those sites. I assume I have to answer the summons electronically through NYSCEF. I wasn't able to find Rules of Civil Procedure either. I wish they would make it easier for someone being sued to answer a summons.:confused:

I have, to this point, sent a letter 3 times asking to settle the account, plus two phone calls where I had to leave a voice mail message because the lawyer handling my account is never there. When I'm called into court, I plan to show the judge the return receipts from each attempt I mailed the offers and my phone log showing that I contacted them by phone also. I don't know what else to do at this point. Forster and Garbus is not responding to me for some reason.:confused:
