I am being taken to civil court by the above mentioned David J Apothaker,Esquire is named as the plaintiff not his law firm..according to papers i received i owe $903 my account was with Credit One Bank..my credit line was for $400..i have bank statements showing i paid Credit One Bank $212..it says my account was charged off have no clue why it was charged off or even went into collections ..i did some research on this Apothaker and it seems he is as spineless as a worm it shows he has a law office in Philadelphia,PA i live in Warren,PA is this guy really going to come to Warren,PA a 9.5 hour trip from Philadelphia

Q: David J Apothaker,Esquire is on record as the plaintiff,does he have to be the
one who has to show up or can he send anyone to represent him

Q: Has anyone ever dealt with him in court

Q: Should i ask the plaintiff for a proof of statement

Any other advice would be helpful.

Did you pay the entire balance? Have you checked your credit report? Credit One Bank is a sub prime lender/car and they have high fees. Your credit line might have been $400, but late fees add up quickly and when you are sued, court and legal costs are added in.

You can ask for a DV but wont have any affect on the court proceedings. You can ask for proof in the discovery phase. Have you thought of calling Credit One Bank and asking them?????

Any other advice would be helpful.

he wont have to go himself. he will get a local attorney to show to any trial or proceedings.
