ARS National

Has anyone ever dealt with ARS National from Escondido, CA. My account was with Redline and I have been paying on it for a year now without any problems. I noticed that they didn't take a payment for July and called them. They said they no longer handle Citibank. I had to call Citibank direct and they gave me the number to ARS. ARS is now telling me that the $50 a month payments are no good and that the only thing I can do is settle. They said they are a third party collector and if I don't settle, they will take legal action. They are telling me that Redline is not a third party collector and the reason that they got rid of my account was because they didn't want to accept my monthly payments anymore. Reline told me that they got rid of all Citibank accounts and there wasn't anything wrong with my account. I think ARS is just trying to scare me, but not sure. I told them all I could do was $50 a month. They said I could send in the payments and they would apply them to the account, but that I should get a lawyer. I don't understand why they would do this if I am paying. Any advice would be greatly appreciated!

I am hoping that someone will reply soon to this post and give me some advice, but I have another question. I am going to send in a $50 payment regardless of what the agency is telling me. There is a payment stub at the bottom of a letter that they sent to me. I figured I would include that with each payment, so it would get applied to the account correctly.

I noticed on the bottom of the stub it says the following:

Quote:
"We reserve the right to process checks electronically by transmitting the routing, account, and check number to the bank. By submitting a check, you authorize us to initiate an electronic debit from your account. A returned check mya be collected electronically if it is returned for insufficent funds."

Does this mean that they have to right to deposit the check or does it mean that they have the right to electronically deduct other amounts from my bank account?

The problem is that your account is seriously delinquent. Paying 50.00 per month on a current account won't even cover the monthly interest, you might as well take your 50.00 and give it to an attorney. Your best bet is to settle and put this whole thing behind you. Regarding a citibank with ARS, call and offer 50% in 4 payments. Get it done and move on, otherwise you'll be paying alot more in the future, when you end up in front of a judge, trying to explain why you didn't hold up your end of the contract that was originally signed.

Mrs. Swanson, this topic is from 9/2007, I'm sure the original poster has long since moved on. At any rate though I would appreciate it if you did not attack members or guests on this forum as it violates the TOS for the site.
