does this collection company sue you on behalf of dell? What happens it i just send them 300.00 instead of 700 like they want. i have already paid them 800.00 and i cannot keep up with those payments but the said the scedule court dates for dell and will sue me if i don't pay. i have only been with them for a month and owe 3000.00. they scare me.. If i send them a monthly payment will they sill sue me like the said and do they own my account now or does dell

i would check with dell,if this is a CA hired
by dell.they can sue,but you have been making payments to them.suppose dell says they sold
the debt,this CA would have to prove ownership
of said debt,if this is a bottomfeeder trying
to make a fast buck then they legally can't
sue you.

if you have been making payments then they sue,show your payments and there taking of payments.it should work in your favor.

Who have you been paying, Dell or the CA?

Did the CA send you a letter stating that they are collecting the debt?

Have you sent the CA a Debt Validation letter making them prove they have the legal right to collect this debt? If not do so Certified Mail Return Receipt.

Also have you checked the local court to see if a suit has been in fact been filed?
Do so. CA will say this to scare you.

If they have sent a statement via U.S. mail, is this a confirmation they have in fact, bought the my balance from "Lowe's" and now have the legal right to file a law suit against me? They are not listed as a creditor on my credit report-what does that mean?

If they do not appear on your credit report they may just not have reported it, or the debt could be too old to report anymore. They wouldn't be listed as a creditor but as a collection agency.

these guys are borderline as well, also serving as CA to among others Cash Transfer centers of payday loan infamy... they have a habit of not liking to follow the fdcpa very well watch them

tired, a cA can sue on behalf of the creditor as well as for themselves(if they bought the debt)...
