I dealt with them this evening and they called my brother to find out my new phone number and told him that if I did not contact them immediately then I would be arrested.

Called them and got a very rude woman on the phone and I knew immediately that this was a collection agency. She broke the fdcpa by reaveling personal info to my brother.

She told me I would be arrested if I did not clear up this debt and I called the Local Sherriffs department and that they told me this was just a scare tactic and they are not able to do this...

I am contacting and attorney tomorrow as well as the county courts office.

There was a message on my phone from a Mr. King stating that my case file was sitting on his desk for possible fraud and that I needed to contact him immediately to handle the case. He also called my best friend and told her that I needed to contact him because of a possible fraudulent case and he gave her other personal information. I have never received any written correspondence from this firm ever. I'm reporting them to the FTC now. I don't even know what this alleged "fraudulent case" is or what it could be. If there were a warrent for me, why haven't I been picked up? Or why hasn't a lawyer sent me something, a summons or something, anything? I had never even heard of Vandenberg until I got the message and then, I googled them. I've run across several other websites with all kinds of crazy complaints and stories. I even went to their website and read and they are in violation of not only federal law, but their OWN so-called policies! Go figure. According to THEIR website, they "use persuasion." It states that they do it while adhering to the federal fdcpa. Not so. Apparently, they don't expect people to know the law - or to be proactive enough to find it out if they don't know it - and they "use persuasion" and scare tactics to, as far as I'm concerned, extort money for old debts that they've purchased.

Don't give them a dime. Get the debt validated, send a c&d letter, and report this agency.

I got a call from them on yesterday 2/2/09. Miss Grishm left a nice message. Then I called them back cause I was like, who are these people. They told me the call was regarding a "check fraud" case. I'm like WHAT! A check written and defaulted in 2005 to ACE for 300.00 it's now with apr int 616.30. I said well you won't get that from me. And how after four years you decided to call me. I asked for a letter regarding this debt, she said they didn't send those. I said how convenient. She asked if I have a credit card number. I said if I did she wasn't getting the number. I really do though... She said we can negotiate the bal. I said to what. She said 451.00. I said still too much. She said we can give you 3 mths to pay it. But you must first pay 300.00. I said absolutely NOT. These people are crazy. She's suppose to call me back. Now that I've found this site, I feel better about the situation. And can answer even better, what they try and throw at me. I wasn't scared or anything. It just weirded me out. Four years later they're calling me. Get outta here! Oh and a supposed supervisor Miss Constance got on the phone (ghetto as all get out) like she was the new sheriff in town, she was suppose to scare me. These people are ridiculous. I told her you can't add fees and all that mess to a loan that's face value is 300.00. I live in Cali there have been court cases for the payday advance places and certain things got passed. She said that was passed two years ago, your case happened in 4 years, so it doesn't apply to you. I just said whateva!!!! Lets shut em' down!

It is scary to receive these calls and embarassing for relatives/friends to receive calls stating you are going to be "charged with fraud". I just went thru this so trust me, I completely understand.
Send them a Proof of debt letter, thru US Postal Service, return receipt requested and 99.9% of the time they stop.
Add in the letter that they are NOT to contact relatives, friends or neighbors and you will only communicate via USPS written mail (never, ever email or phone).

Don't buy their threats, if they had a case they would just file it and be done with it. The fact they have to threaten shows they have no case and they are nothing but "old schoolyard bullies" who more then likely ALL have criminal records and cannot get any other type of job so they resort to this instead of honest labor.

Unfortunately, that is not binding on a CA. The Cease Comm provision of the FDCPA is an all or nothing. There is no law to back up contact via USPS only.

Correct Nascar Devil BUT I was told by an attorney that most judges and courts don't recognize emails.

Why the flack about advising people to cross "t's" and dot all "i's" by simply sending all letters certified return receipt?

But for those who wish to follow advice and use email, true most won't follow thru with court but what if they do and the court won't accept your "emails"? Why chance it for something that cost about $2.00 to do? They almost never respond, you have the info and it is done.

Emails they can claim they never got. heaven forbid someone other then a "moderator" suggest info that might avoid heartache farther down the line for people.

I would contact you but their is no contact info, lol. But I think it would be a good idea to start a class action lawsuit. I'm not a lawyer or anything, I'm just a consumer that this company is trying to get money from.

No where in my post did I make any mention of e-mail. I have no idea how you made that inference. I stated that demanding that all communication be via USPS has no case law to back it up. The cease communication wording in the FDCPA is just that...to cease commuication. There is no statute to enforce a CA to limit there contact to USPS only.

You are the exact reason people STOP coming to this forum in droves. You have zero soft skills in talking with people so you will be reported to the site admin. You are a moderator? What a joke yet you put down other people and hold yourself above everyone? Big ego = ???
SameBox Response from "NASCAR_Devil":
People stop coming here because their financial issues have been solved and they have no further need of help. Those that stick around do so to give back to the community that assisted them.

How was I wrong in my post? You didn't read my initial post, made some bad assumptions, and I'm the one with zero "soft skills"? (WTF is a "soft skill"?)
