Counter Sue for What?

I have suits filed against a couple of agencies for violations of the FDCPA and Florida laws also. These are federal and state laws that were broken! I have had. on a couple of occasions on this site, been told by collectors, or people posing as them, that they will counter sue and in one case "ream my a--!" I would love to hear what they think they can counter sue for. I could use a good laugh. Mods please do not delete their answers unless they are really offensive!

This is a serious question, I would like the collectors to explain their remarks based on fact. Censoring someone who has a contrasting opinion is wrong. I clearly stated in my post to delete anything really offensive! But why should we lock a thread because it may become controversial if it offends no one.

JCEMT, I think Frog has a valid point on this. But as we have seen most of the time they don't defend they just throw the insults and run. If it gets out of hand then lock it down. Just mho.

I agree frog as long as you stated it doesn't get out of hand I believe that we would all like to read the responses, I know for one I would.

Since no one has answered I will give you what the fdcpa says,a collector cannot bring up the debt as a counterclaim. If you case is not solid you could end up counter sued for costs/lawyer fees.

I have counter claimed two times but not for the reasons you have listed frogpatch. I had asked to have accounts validated and they were not, I had attempted to straighten things out but they were sold to other CA before replies, etc., not even giving a person the chance to correct the problem. One CA would demand XX amount of money and another CA would send a letter with a different amount, etc. Both were dismissed and agreed in the judgement they could not be brought up again, which ended the issue, but it wasn't because of their tactics, which were not very good either. However, I felt it hard to prove what someone said to me unless they would be goofy enough to leave it on an answer machine. Just an FYI frogpatch, if any of these collectors were not third party, I don't think the law applies to them. Example, if you owed Ford Motor Co and their collection department calls everyone and their brother, including your job and neighbors, I believe they are not touchable under the FDCA.

Sounds like you've had lots of dealings with sundry collection trolls on this site. Best not to feed them. A collection agency with an inhouse legal department can get you sued so fast it'll make your head spin. They sue to collect the debt owed. If you have issues with the collector or the agency contact a consumer rights attorney and see if you have a case. No case? Try to negotiate with the collector... don't like the collector? ask for a different one. Being difficult on either end hurts both parties and just clogs up the legal system.... the collector loses a comission and the person owing the debt risks getting sued. And that sucks. I'd rather help settle a $5000 account for $2000 than see the person get sued and have their paycheck garnished --- or a lein put on their house --- or a checking account cleaned out. All of which can possibly happen.

PS You present a lot of valuable information on this site but there are some inaccuracies
