nwheeler14 you need to stop making false statements. They do not use fake names or an alias you can refused to pay what you want voluntarily but keep in mind the law does allow for creditor garnishment and seizure of wages and assets such as property, boats, etc,and some instances savings accounts You might want to keep that in mind when speaking with any law law firm unless you dont mind paying attorney fees and court cost. one last thing letters and faxes wont get you a settlement will only escolate the matter to court a lot faster.

oskey it wouldn't be in their best interest to accept any offer after all most states allow garnishment and seizure of assets so why would they accept some low offer when they can get more money involuntarily

nwheeler14, please keep in mind that the actions described previously can only be taken if a judgment is awarded (unless a voluntary wage assignment is included in the contract, which you can revoke in writing)

If the amount seems much higher than it should be I suggest requesting validation, you can find a good template for a validation letter via my signature which should be sent USPS, certified mail, return receipt requested.

If you have any further questions please feel free to ask.

Hey, shill!

Now that I've got your attention... Remember that you're a guest in our house when you're on this board. Act accordingly, or you'll wind up as just another pinhead that nobody reads.

Hey ladybug,

I know what you mean and can understand your situation. However, if you are in a garnishment state like I am (Virginia), they can not only get Judgement (up to 20 years) they can also file for Garnishment and take up to 45% of your wages (Henry County, VA J&D Court-Judge Williams) and I hope that you are not in a situation like that. I owed not just on credit cards, but also had some hospital bills too. I was strung up on the credit cards faster than the hospital bills. How did it leave me and the family? Living with relatives for the past 8 years now until the debts are paid. How much longer do I have, about another five years. However, you have to remember this, the credit card companies can also send you a 1099 form as misc income which you will have to report as income on your taxes and you will have to pay the IRS like I have been doing with Bank of America. Now I owe the IRS over $9K.

45% of your wages? I kinda doubt that. I seem to recall that Federal law sets a limit of 25% of disposable income.

Looks like Garnished is full of crap.

Your right Unclewulf, federal maximum for percentage allowable for wage garnishment is 25%, that is total.

So if one creditor is garnishing your wages for 12.5%, another can garnish your wages for up to another 12.5% up to a total of 25%, once this capacity has been reached any further judgments would have to be place on hold until an existing judgment is satisfied.

State statutes are passed to supplement or to add to existing federal statutes and a state cannot pass any laws whose purpose would supersede federal statutes unless the existing federal statute was amended or abolished to allow this.

sounds like you have a pickel on your hand I had a run in with the firm also. My experience was horrible I did have to go to court they actually served me court papers at my job. I disputed the debt at first because of the fees they tried to hit me with which didn't work my lawyer told me it was best to settle out of court only problem was about time we settled I ended up paying 6k more then I originally owed due to the lame attorney fees and court cost I could have avoided the problem by taking care of the debt sooner vod did bur me about a week or so they where fast with the requested documents. So be careful when requesting documents rannefeld is quick to threaten action because they will. They want to get you to court so they can get more money from you Ken Chandler kept saying that it was nothing personal but business. He stated they make more money getting the files to court then they do at first due to the additional fees that are added. My attorney it seems gave me the wrong advised not only did I have to pay him 1200 but had to pay CACH attorney fees also all because we kept holding out and stalling hoping they would settle for less which didn't have my advised would be to try and pay early because waiting out doesnt always save you in the end.

Hmmm........

I think one of two things happened here. Either you hired an idiot for an attorney, or you think we're idiots. Which is it?

I probably was an idiot for listening to you guys. Always telling people to file suit that doesn't always work. I tried that and it failed only pissed off them more. It would have been nice to know that me verbally telling them not to call doesn't work

If you were actually listening to us, you'd have known that verbally telling them not to call doesn't work. Nice try, shill.
