Sub: Payday Loan garnishment in Arizona
Tue, 05/08/2012 - 10:11

I had taken out a payday loan and was unable to pay it back in full. I was wanting to set up arrangements for re-payment but instead they are threatening with wage garnishment. I know that payday loans had become illegal in Arizona last year so my question is what exactly are the able to pursue? I want to pay my debts but not through garnishment.

Thanks,
Jason

When did you get the loan? Who is the lender? How much did you borrow? Did you pay anything back before you defaulted? If so, how much was debited form your account?

Paradise Cash Advance is in the UK. This was not a legal loan. You only should repay the principal of $200. Anything you've paid to them thus far can be subtracted from that amount. Did you pay anything before you defaulted?

Is this the actual lender calling or a third party? Do NOT pay ANYTHING to a 3rd party collector on an illegal loan.

You may have signed, as part of your contract, a wage assignment agreement. These are voluntary and can be revoked at any time.

Take a look at the link in my signature line.

Thank you very much for your help in this matter. Between your response and reading up on info at the Arizona Attorney Generals website I feel much more comfortable and not stressing out anymore. Thank you again.
