It would take up too much space to tell about the whole thing but to sum this up- 3 1/2 yrs ago I got a credit card from HSBC. I paid on it for 2 yrs and realized that 'something wasn't right', the amount kept going up even though I was paying on time and I noticed weird fees with no explanations. I called the company and asked about it and they had no written explanation or one in their system and they were just listed as misc. charges. I went back and forth with them about it, even talked to their dept mgr but don't remember his name because frankly, I didn't think I needed to at that point. This was also around the time when the payments started not going through and their "system" problems started. I spoke to them about that, they said to just pay earlier, it got ugly, I told them to remove all the extra charges I had not know about, they refused. I asked for proof of what they were for, they could not produce it. I told them to charge off because it was obvious they were taking me for a ride for quite a bit at that point- basically saying I owed a huge amount and it should have been just about paid off (making double payments sometimes and always over the 'agreed' amount). At that point, I learned about the fact that you couldn't get statements online even though they said you could and they refused to send me any but said they had sent them.

Skip down to last year- I got a letter from Arrow financial stating I owed THEM even more for that account. I sent a cert letter asking for proof with all my info I had from the previous battle with HSBC. I never heard back. I moved and lost the copies of all that. I looked on my credit report and it showed the account with them was open and them closed.

Skip to the end of 07 - I get a letter from Frederick J Hanna stating I owed even more for the account. I sent a letter asking for validation. They sent me a letter back stating "You owe X amount because they say so". That is not going to work! I sent them a "Validation Proof" letter asking for them to validate the debt in FULL. I did not hear back. This week I had a note on my doorstep stating a county sheriff had stopped by and has a civil paper for me. I can only assume they are going to try to sue.

In the meantime, I get CONSTANT calls from numbers that have been shown to be from Hanna. ALL hours- call- hang up, call- hang up. Usually it's just one ring! Very annoying.

NOW- according to my Credit Report- it shows that HSBC account is closed and Paid as Agreed.

I have looked all over the web for info on how to fight these guys but can't find anything. I want this to go away and it seems nobody can win against these bottom feeders. They continue to do illegal practices against the Fair Trade Practice Act! I want to fight but do not have the funds to pay for a lawyer.

Can anyone help!?!?

First thing get all your documentation in order and make sure that you show up in court. If you don't you will lose by default. HSBC is the worst. I had a lawyer take me to court and I wound up paying the legal fees on top of the amount I owed. The difference was I really owed it. It sounds as if you do not. Do you have your cancelled checks or old statements? Others with better knowledge will be along to help you. Hang in there. Go to this link and read about the scum you are dealing with. No I don't have anything from back then. I did payments all online back then also. I only have the letters from this last go-around......

He is a lawyer and will help you. There is an email link there also. Hannah is listed as Americas Worst. What a distinction.

I'm dealing with these bottom feeders. First call your state bar association to see if they are even licensed to practice law in your state. Check the plaintiff's council listed on the summons for Bar licensing.

Also, get yourself a attorney to represent you (naca.net is a good place to start looking) make sure your attorney requests validation of debt during the discovery phase under a motion to show cause.

If they resort to suing you when you request validation they are trying to skirt it and go for the throat. If they couldn't produce validation then, they probably won't be able to produce it now, your legal council will probably then motion for dismissal due to failure to show cause.

Lastly, these misc charges sound like a big violation of truth in lending (which I think is Reg EE)

I actually have emailed Bud Hibbs a few times and he responded with the letters I've sent so far. I also emailed Clark Howard's Team yesterday and hope to hear back from them..........

If your credit report shows the account as paid as agreed I do not see how these people (I use the term loosely) think they have a chance. Try as JCEMT says to get a lawyer. The NACA lawyers will very often work with you as far as paying. It is better to pay your own lawyer then to pay someone elses on top of money you do not owe. I think one letter from a real attorney will be enough to scare them off. You may even have a good suit against them.

Also on my credit report- Arrow Financial is on there- it shows I had an individual account with them which I NEVER agreed to or took out and it has an amount almost double what it is on the HSBC account- HOWEVER- I did dispute it so it shows that on comments. It shows Factoring Company Account (debt purchaser) -whatever that means.....

They use that to try make it post as a regular trade line as opposed to a collection account which will hurt your FICO score more. Big violation of the Fair Debt Collection Practices Act.

Arrow is another collection agency. They may have had your account and them sold it.

I have been looking around online for info on what is legal and not but can't find anything that has to do with what they can put on your credit report. I did contact a lawyer, one of the very few in GA that deals with this sort of thing, and her fee is half of what the collection agency says I owe- I certainly can't afford all that!!!

Did you try NACA? They are listed by State and by their experience. Georgia is a big place I am sure she is not one of the few.
