WW&R are a bottom feeder lawyer group that are debt collectors, they will claim to have been hired by Cap1 but they werent, more then likely they were hired by LVNV LLC. Get educated on your rights and be prepared. I am being sued by them currently, just filed a motion for Definite Statement, They will try to scare you into paying, but as long as you keep yourself educated on the law's and take all the necessary steps you need to, to keep you legal you have a better chance of winning and getting this closed for good!

As Kal said, educate yourself with this company! Like was previously mentioned, I dealt with them, and they don't play fair.

Alot of the debts they have, they have been passed from LVNV, or their many dbas', they were bought as charge offs.

Once when I did talk with them,they stated they knew I was "debt educated"!! This was after informing them in a letter and on the phone of my rights.

The best thing to do if you are sure that they are the ones to be collecting, is to send them a debt validation letter. They probably won't respond, so send them a follow-up letter,along with a copy of the first one.

Be sure and document, take notes of everything and send it certified, return receipt--Good Luck..Karen

If available, I would check the court websites of places you used to live. WW&R like to sue using old addresses hoping to gain default judgements.

I THINK THEY USE THE ADDRESS LAST LISTED BY THEIR CLIENT, FOR SOME REASON PEOPLE WHO OWE MONEY LIKE TO MOVE AND NOT UPDATE THEIR ADDRESS ANYWHERE...HMM WONDER WHY?

ALSO ONCE IT REACHES THEM I WOULDNT CALL IT DEBT COLLECTION AS I WOULD CREDITORS RIGHTS...JUST LIKE YOU HAVE RIGHTS AGAINST THREATENING CREDITORS, COMPANIES LIKE CAPITAL ONE HAVE RIGHTS AGAINST PEOPLE WHO USE THEIR LINES OF CREDIT AND DO NOT PAY IT BACK.

LIKE RMAJ SAID IF THATS WHAT YOU CAN PAY WHEN YOU CAN PAY THEN THATS ALL YOU CAN DO EXPRESS THAT....YEAH YOU MISSED MONTHS WHICH IS WHY YOURE IN THE POSITION YOU ARE. JUST DO WHAT YOU CAN YA KNOW ITS BETTER THAN NOTHING!

I WOULD SUGGEST SEARCHING YOUR MUNICIPAL COURT SYSTEM AS OPPOSED TO GOOGLE THESE GUYS, EVEN BURGER KING HAS NASTY STUFF WRITTEN ABOUT THEM BUT I BET YOU STILL EAT THERE. IF ITS PAST SOL THEN CONTACT THE CBR'S TO REMOVE IT THEN YOU DONT HAVE TO WORRY ABOUT...DANG THIS SOUNDS TOO EASY. EASIER THEN WHINING ABOUT ANYWAY.

OH AND VALIDATION, PEOPLE... IF YOU DO ALL THIS RESEARCH AND ARE SO KNOWLEDGEABLE YOU SHOULD KNOW THAT IS THE CBR'S JOB, CONTACT THEM THEY WILL REQUEST IT FROM CREDITORS AND THE ATTY'S REPRESENTING THEM. THIS ISNT THAT HARD PEOPLE CUT THE HEAD OF THE SNAKE OFF NOT USE "STALL TACTICS" SIMPLE FACT, MOST LIKELY YOU OWE THE DEBT, YOU KNOW YOU OWE THE DEBT AND INSTEAD OF TAKING RESPONSIBILITY YOU WANNA TAKE THE HARD ROAD AND FIGHT WHICH TO EACH HIS OWN WHATEVER BUT DONT BLAME SOMEONE ELSE FOR YOUR MISTAKES.

I am in the process of negociating with them but I have no proof that they own the debt. Capital One has no knowledge of it and I am just confused about what to do. They are suing me and I don't even know if they own the debt, I highly doubt it. I don't want to pay for nothing. Help.

Advocate is full of so much BS their eyes must surely be brown. So much crud that I don't even know where to start!

The biggest one I will mention is it is the CRAs job to validate. Actually, it is not. It is only their job to make sure anything they list is accurate. And just for your information, they do a lousy job at that.

Validation MUST be from the collector getting correct information from the original creditor and forwarding it to the debtor. That is right there in the law, black and white, no question about it.

People here are asking about their rights and asking what can be done when those rights are trampled all over. That is not whining, that is becoming educated on your rights and fighting back.

The simple fact of the matter is this:

If the collectors would follow the law, there would BE no boards like this. If they followed the law they would get paid much quicker. That is the thing I find the most funny. Most people would pay their debts if they knew the collectors were acting ethical and following the law....think about it..if someone is getting belligerent, making threats and being rude...it makes you wonder if they are for real.

These people are awful! They will sue quickly and they lie! Get everything in writing when you deal with them!! Know your rights! We need to shut them down!

For those of you being sued by Weltman on behalf of Capital One, I just found out by calling Capital One that Capital One uses an attorney network to collect on deliquent accounts and Weltman is actually one of them. I was surprised to be honest--so Cap 1 does use bottom feeders to sue and collect on their behalf. Not all accounts are sold to these losers, they actually use them as their collectors.

Please educate yourself on the legal process. First things first. Don't avoid the conflict confront it. Check your credit bureau and give a written response to collection letters. Do not attempt to negotiate on the phone unless you are able to make arrangements preferably settlement. If there is a lawsuit against you--respond to the suit or go online and find out how to respond. If you do not respond within the time frame this results in a default judgment. Once a judgment has been issued they can garnish your wages, place a lien against your house and swipe your bank account. If a judgment has been rendered and you think it is unfair then file a motion to vacate judgment. If you have a joint account that has been swiped petition to have these funds returned.

I'm glad to hear they do not validate. I sent them a DV in April and so far have received no response. It did stop the multiple calls per day so that was nice.

If you don't pay today there is nothing they can do. Just pay on Tuesday, tell them that and if they don't like it, too bad. They can't have you arrested, they can't get a judgment against you by Tuesday so there is nothing to worry about. Just pay on Tuesday you will be fine.
Bad advice. Actually, really f'ing stupid advice. Been there. Tried that. Although they can't arrest you - they are damn quick on getting judgments early the next day. This is a spin your bottle and take your chance.

I co-signed a student loan for and the law firm has made me make 3 $200.00 payments and now say that will not be enough and want the entire 5,000 interest and a payment plan on the remaining 12,000. I would be happy just to be able to continue to make the $200.00 monthly payments. What can I tell them? Will they demand the rest, can they?

No one is going to get a judgement from a court the next day! LMAO The only way someone is getting a judgement the very next day is by going to a printers and having a fake one printed.
